For H&C since you are posting under the H&C topic? Did he/she get AIP or PR? Under what grounds?
He got PR under H&C, no wife no kids, just a working young professional. It's rare to win H&C for people like him. I think the officer is very good person.

Hi, I need advice, my h&c application got approved (stage 1) but immigration need to know how I'm supporting my family financially. I am on welfare and I'm unable to work because I was met in a car accident ( I got hit). Is it a possibility I get refuse. Any suggestion on what can I do?

Yes unfortunately that could lead to refusal. You need to show that you are financially self sufficient or at least show that you are disabled and qualify for disability which will give you a better chance to be approved. Canada does not want to approve people to stay on H&C grounds who are going to be dependent on welfare and not contribute to the Canadian economy. How long have you been on welfare? When was your accident?

Do you mind me asking when( month & year) you submitted your H& C application for PR?

In my situation, I use a lawyer for my application. My lawyer included my bank statement in my H&C application. My bank account is well funded with a lot of money. My lawyer also included an official letter from my bank that attests my account in perfect standing and I have no debt. I am aware that IRCC does not require applicants to include these bank documents. From my observation, the reason why I think my lawyer include it as it shows that you are self-sufficient is you have a huge amount of money in your bank account and account in good standing. Your bank has to issue an official letter to attest to this. every client that my lawyer help with H& C application got approved without IRCC asking them to provide evidence to prove that they are self-sufficient

From my understanding of the laws in regards to PR via H& C, The immigration case officer need to be convinced you are self-sufficient without the need to depend on the government for welfare. This is a key requirement that unfortunately, IRCC is less forgiving. Most likely they MIGHT have that information on their system of you been on welfare. I am not 100% though.

I will strongly advise you to seek legal advice on how best you can explain your situation to IRCC. That way, your explanation will be strong enough to convince them that CIRCUMSTANCE BEYOND YOUR CONTROL IS WHAT LEAD TO YOU BEEN ON WELFARE. Your argument and explanation have to be very strong, compelling and convincing.

For that reason, I will say seek legal advice.

I have been on welfare since November 2017. I was in a VAW shelter because of my abusive partner, it all started from there. My accident was 2019 May

I understand where your coming from. They know that I'm on welfare, it's in the system. Thanks for the advice.
I submitted my application in November 2018 got approved june 2020

pls, I am in need of of a serious advice .

I applied for my for PR. My application was submitted 29th of june. I receive both AOR and Biomtric on the same day( 2nd of September) . Fortunately, I am exempted from biometrics since I have done mine in last 10 years ( according to the new IRCC policy on biometrics).

I am told that after some few weeks or month by a friend that IRCC will send me a Instruction letter for medicals. medicals is the next step after biomtric.

Here is my concern.....

I have been watching the News for the past 2 weeks. It appears there will be a second lock down soon. It is very likely because the government has been talking about it non-stop on the news and are gradually imposing restriction on businesses.

HERE IS MY QUESTION...

1) Do you think it is wise idea for me to go ahead to do my medicals now WITHOUT waiting for the medical instruction from IRCC ?

2) Will this move in any way affect my the decision of my application ?

I ask this question because I dont have a situation where the lock down will affect opening of medical clinics. if they are lockdown, it means it will affect my ability to get my medical on time and in turn delay the process of my PR application by IRCC



PLEASE NOTE :

1) Medical examination result is valid for 1 year

2) My PR via H & C application ( Inland )

3) My application is PAPER BASED ( not online)

4) Application submitted at the IRCC Vancouver office

You can generally apply for social assistance / welfare. However it's possible that doing so will work against you in getting the H&C application approved.

I know someone who was on welfare while applying for H & C and they gave her AIP then she immediately stopped the welfare before forwarding documents for second approval and she was approved

Yes - we've seen different results here. I think a lot depends on individual circumstances and the basis for the H&C claim.

We've seen some people approved who were on social assistance - no issues.

We've seen others who have run into problems and been refused due to this.

There's some information below on this from the IRCC manual. I think your friend's situation fits this and it makes sense she was approved.

Hello guys, how are yall doing..... happy new to you all.

I will like to ask if anybody has received medical instruction lately and approval of their application. if so, when did you receive yours and when did you submit your H& C application?

I submitted mine on 30th June 2020. Received AOR on the 2nd of September. This month(January 2021) is my 6th month waiting for mine.

I will appreciate your response.

What was your status before applying for H&C? If you were a visitor the no you won’t qualify for social assistance.
