yes i spoke with 2 of them about my problem they told me that i will have implied status also my lawyer said the same thing, wth is that ! i will verify again with them tommorow and i will speak with the deputy of my region, and also i will try to find another lawyer

Hi @scylla ! can you give me a source about this information from IRCC website please ? because I searched for several days but I found nothing, also i don't understand why call center told me yes i have implied status and also my lawyer, actually i wanted to verify this informations with others because lawyers are not all honest and call center they don't know well their job.....
so if i will not have implied status they can deport me ???
See the following IRCC web page. You only have implied status if you apply to extend your status or change your status before your current status expires. If you are already out of status, then you don't get implied status through submitting a new application.

A temporary resident must apply to extend their period of authorized stay before it ends. Provide more details about your case. Do you still hold a valid visa? Based on your previous post, it sounds like you applied for an extension which was refused. Is that right? Is your current visa still valid or did your visa expired after you applied for the extension? All of these details are very important.

no my visa expired before 2 months i think, i never been out of status until they refused my application, they send me IMM 5021E form, volutary departure

All you can do is trust your lawyer and if you think the call center is right. All the forums have different answers for different cases . Don’t take all the answers as solution for your case. Some of them don’t apply to your case. Be positive. Every situation is different

In that case you are out of status and a TRP will not give you implied status. You would only have implied status if you had submitted the TRP application before your last visa expired.

However this doesn't mean that CBSA will automatically remove you if you don't leave yourself. You can certainly still submit the TRP application, remain in Canada without status and hope for approval before CBSA forces you to leave. It might still work out.

but it's just because I don't like the fact that I am or maybe without status.

I don't know if they can deport me directly but I hope not I will certainly find a solution !

Trusting lawyers is fine.

The call centre cannot be trusted to answer complex question. We see them give out wrong answers regularly. They should only be trusted with extremely basic questions.

CBSA can deport you once your departure order turns into a deportation order (i.e. after 30 days). However I don't believe they are actively doing this right now due to COVID-19.
