PR cancelled due to PCC incomplete

Hi if this was going to be this nerve wracking I would have hired an immigration lawyer. They charge the full fee even at any stage and now I become hesitant.

Please help any possible way.

MY SUMMARY

- INLAND APPLICANT

- Moved to Canada in Jan 2015 and finished masters program in Canada

- EE CEC INVITATION JAN 2020
- AOR APRIL 8 2020
- POST GRADUATE OPEN WORK PERMIT EXPIRED MAY 15th 2020
- BRIDGE WORK PERMIT APPLIED ON APRIL 12TH - NO UPDATE

Yesterday I received an email update for my EE application that it is cancelled due to PCC. I have no criminal records anywhere.

Now I am finding some posts in South Korea PCC system that contradicts with CIC immigration. I made an error of updating the one missing CIC requirements.


The page shows as "cancelled as incomplete"

With a letter stating:

Immigration, Refugees and Citizenship Canada (IRCC) has reviewed your application for permanent residence. We have determined that your application does not meet the requirements of a complete application as described in sections 10 and 12.01 of the Immigration and Refugee Protection Regulations. Your application is rejected for being incomplete. Specifically, your application does not include the following elements: - Police Certificate: The police certificate from South Korea you provided with your application is not acceptable as it does not indicate that all records have been searched, including any lapsed records. Please consult our website to obtain more information regarding the required document: https://www.canada.ca/en/immigrationrefugees-citizenship/services/application/medical-police/police-certificates/how.html Note: A full review of your application was not performed. There may be other elements, not identified above, which may also be missing or incomplete.

I am going to submit a webform, what would be the most persuasive way to write and reopen my case?
As seen in my summary it is almost impossible to get back into the pool. I am still living in Canada.
IS THERE ANYONE WHOSE application got cancelled due to PCC but successfully reopened the case via webform?? Please comment and individually msg me as well.

PLEASE HELP.

Unlikely to reopen your case, i'm just being honest.

You can try however, but i would get back into the pool and gear up to send another application once you receive an ITA.

I did not get the reason why exactly it was refused? Have you submitted the PCC? something wrong with it?

Also, it's we've CIC mentioned the reason as to *Incomplete* even though they have mentioned they will not refuse any case because of incompleteness or missing documents.

BTW.
I made an error of updating the one missing CIC requirements.
what was that?

How quickly are you able to get a new updated (*according to their instruction) PCC from S.K? if soon, I would attach the new letter and request to consider at back, As you made an honest and mentioned the fact that you were kinda laid back and relaxed as CIC website says no case would be refused because of incompleteness. I mean, give it a last shot, maybe because if pandemic they would be more lenient.

That's my personal opinion. Wair for senior members comments and decide how u want to move forward.

@royalstellar Could you please update on the course of action you took and whether any efforts are successful in reverting the decision?

My application was also rejected for being incomplete due to PCC. I applied in Express Entry through the BC Provincial Nominee. I am an Inland applicant.

I applied for a PCC from Pakistan from here in Canada through the Consulate. However, I was not able to get the PCC in the required timeframe . Believing the IRCC website that says that "no application will be returned as incomplete due to missing documents in COVID-19", I went ahead and submitted my application. I attached my old police certificate (that I used to apply for my study permit and was issued 6 months before I left Pakistan), along with receipts from the embassy showing my efforts to obtain a new one and clearly explained this in my LOE.

The officer rejected my application because the police certificate I provided was old and does not sufficiently cover my time spent in Pakistan.

I still haven't received my PCC. Now my application has been returned as incomplete. :(

My previous PR application was also once cancelled as incomplete due to an incorrect PCC. I didnt have any other option but to resubmit my profile

@pisces88 Thank you for the reply. Do you know if there is any way to reuse the old profile information or do I have to refill the profile form from scratch? I also had a provincial nomination so I will have to look into that.

i am in the similar boat but my current status is in process - pending background check due to PCC with lapsed record.
The only difference is I have been aware that this document is no longer able to obtain based on South Korean law. I have included letter of explanation along with SK consulate in Toronto official reply where stating it is illegal to obtain that document and they can’t issue it, etc. With my original submission.

did you provide LOE??

yeah I did include a paragraph in my client information Ietter saying that it will be delayed. I mentioned that I have also included my old police certificate so they could see I have no criminal record for most of the time.

You’re welcome. My agent was actually the one who resubmitted my profile, so I really didn’t have a clue on whether it was filled out from scratch again or not. I also lost my provincial nomination from Alberta as it couldn’t be linked to the new EE profile.

You should not have included an old pcc. Basically they just looked at it like an invalid pcc.

I am in a similar situation. Just gotten a cancellation due to incompleteness. Should i try to upload a new certificate or just forget it?
Hi,

I got my PR application reopened after getting rejected. I raised two webforms, one telling them that IRCC policy is that not to reject documents missing due to COVID. After a couple of weeks, I got my PCC so I raised another webform sending them my police certificate I was explict that the delay was due to COVID and asked them for reconsideration. They reopened my file after that.

So do raise a webform if you attached receipts showing your efforts to obtain a new one and if you explained the delay in your LOE.
