Hi Everyone,

URGENT REPLY PLEASE

I am an international student and my work permit in expiring on Feb 26 2017.

But i got DUI in September 2014 with level of 174 alcohol in blood and im still fighting for it and my trial date is on May 09 2016.

Unfortunately On March 14 2016 got arrested again for same charge with alcohol level of 159 and 163 under section 253c1(b).

I am wonder if i Can apply for work permit extension now.

No point. You aren't going to get an extension with pending charges.

You'll have to wait until the court cases for both charges have been completed.

Hi scylla, Harry has 450+ points in express entry pool. Say if he got the invitation this year, his pending DUI cases will cause delay or other issues in becoming permanent resident???

What happens if i get criminal record?. Can i apply for extension of work permit or apply PR?

What the are chances of applying PR on behalf marriage?

Sure it will cause delays. Pending charges are supposed to halt application processing until the charges are dealt with.

Assume the situation will become more complicated if you end up with a criminal record. You should be working with an excellent criminal lawyer to hopefully get the charges reduced to a non-DUI.

Marriage won't fix anything.

A DUI makes you inadmissible to Canada. You won't be able to apply for another stay in Canada until you qualify for rehabilitation, which will be many, many years from now.

Aside from the immigration aspect, driving drunk so many times (and who knows how many other times you did it and weren't caught) with a blood alcohol TWICE over the limit is moronic. That's not something you can mitigate or argue away. Having lost someone to a stupid drunk driver, I do hope that you are convicted and pay the serious consequences for your horrible decisions.

Dui are pretty straight forward and as far as your situation is considered, you have nearly nil chances of getting away without a criminal record. The prosecutor will slam you with a conviction and your defence is nothing coz you are caught twice. Having said there might be a chance of yours if that was your first offence but since u are caught twice your conviction is inevitable .

if you are convcited , you will be given deportation order for sure . My friend was charged with dui aND was told to leave country immediately .

with pending dui charges , the op can't apply for pr as he has to declare on imm 5669 form abouut the pending charges . A conviction will defiantly lead to deportation .

My room mate has his work permit extension and PR application last July 2015 then had a DUI charges within the same month. His WP has been refused along with his PR application after 5 months. DUI makes you inadmissible to Canada. He receives a number of letters from the Government and just recently last Friday to be exact he received a deportation letter.
I suggest you find a good lawyer for your DUI charges.

Sorry but Canada wants people who will obey the laws . One DUI is bad enough but 2 and as other poster has said goodness knows how many times you did not get caught. I think your chances of getting any form of PR are slim regardless of how the court case turns out as you have shown a disreguard for the law and as other posters have implied even your current status could be under threat. I am sure you will reflect that whilst on a temporary permit you should have made the effort to stay completely clean and law abiding until you achieved your end game. Not that you shouldnt do same once PR achieved but DUI is one offense that not many people have any sympathy with.

But my permit expired again this month and I have re applied. Only this time the CIC sent me an email to do a Criminal check from the police. I’m really worried if this pending charges denies my application. I barely have a semester left to graduate. I never committed a crime in my life and was always in a good moral. I am thinking what’s my worst and best options right now?

Generally speaking IRCC won't issue, extend or renew a visa while charges are pending.

I don't think you have much choice but to send IRCC what they have requested and hope for the best.

Is there a reason why the charges have been pending for so long? That seems like an unusually long time.
