Hi there,
I need guidance to give my daughter a bright future.

I'm a 32 year old lady, who married in 2015 with a men who holds Canadian citizenship and i become a mother of one baby girl( my princess)in 2016, but my husband didn't happy with me because I didn't give a birth baby boy and he left me alone in pakistan and travel to canada Toronto and refuse to process my documents to bring me and my daughter to canada. After some time he stop to pay CAD 200 per month to me to afford myself and my daughter then my family took over the responsibility to raise my baby girl and take care of me during this hard time.
After a year and half with frustration I decide to file a legal case in Pakistan court for separation with holding my full rights on my daughter as my husband never wants. And court granted. Now she is 4 year old and very happy.


Question. I want to know is that is my daughter consider a Canadian citizen as she was born from Canadian father as well as before my marriage break down?

If he was born in Canada or became a naturalized Canadian prior to her birth, then yes, she is a Canadian citizen. However, without the cooperation of the father, you will not be able to obtain proof of citizenship for her, as he is required to provide his citizenship documents.
 
Would also add that your child having Canadian citizenship won’t make it possible for you to live in Csnada.

Thank you for your time and answer my question, please tell me that, is it possible if i will come to canada to visit my blood brother on visit visa with my daughter and report a case in canadian court or to concern authorities against my ex husband as he didn't respect the pakistan court order and not paying certain amount until certain age of our daughter.

I dont want anything for me, i dont have a wish to stay in canada, but I cant compromise about my daughter rights. I will try my best to provide her what she deserves?

I dont no what do I do? Please guide me.
 
What would you be trying to prove in Canadian courts? It’s ultimately a civil matter, so you would need to pay a lawyer to present your case, what ever that might be. Note there is no reciprocity agreement between any Canadian province and Pakistan, so a ruling for financial compensation is unlikely and probably unenforceable.

Also my question is that, Does canadian citizens had right to marry any other country girl and give them a baby and treat them like a garbage and forgot them as they were not human. In many case girls doesn't comes up to raise the voice against this kind of situation.
But I'm trying.. please guide me to whom I have to contact in canada in this kind of civil matter?

I asked my brother to help me and invite me to canada as a visitor, so where do I need to go? From where do I need to start.
My brother said he will takecare of all expenses if there is any. I need guidance or directions please..

Yes I know there is no reciprocity agreement between countries, so that's why I'm asking, if I will come to canada on visit Visa with my daughter and contact concerns authorities to help my daughter for what she deserves.

To be approved, you will need to show that you have strong ties to your home country (e.g. job, property, assets) and have no plans on remaining in Canada long term. It would be much better if you can show that you have the money to pay for this trip yourself instead of asking your brother to pay for everything. The chances of approval are higher if you pay for your trip yourself.

If you want to pursue your husband through the court system in Canada and have him pay to support your daughter, you would need to hire a lawyer in Canada to represent you.

As said above, you can hire a lawyer in Canada to pursue a case against your ex for child support

There is nothing illegal about marrying a foreigner, having a child and leaving them. It's not a great situation but not illegal.

Currently I live with my mother, I dont have a property or assets, but I do have a bank balance to afford my self and trip.
Even if court or concern authorities in canada grant my daughter a Canadian citizenship status she will stay in Pakistan with me, and when she will be 18+ its upto her if she wants to go Canada for studies and to enjoy her life. So that's why I'm preparing today to give a bright future to my daughter. She is 4 years old now.

It's fine if it's legal or illegal, I dont want anything for me, but what incase if one day child want to claim her citizenship if her father were a canadian citizen at the time when she was born? She can claim or not? Or she will be consider a Canadian citizen or not even if wants to claim at the age of 20.

As I said, her father's documents are required for her to apply for proof of Canadian citizenship. If she can't ever get the required documents, she's basically out of luck.

It's fine for me its she didn't get the citizenship, but I want her father to pay child support every month which will add to her account till she become 18 and then she can use that money for her studies or whatever she wants. Alternatively till I'm alive I will takecare of my daughter, she is a blessing on me.
