Hello everyone.
  • Could I apply for refugee grounds if I have a pending humanitarian and compassionate? How can I withdrow my humanitarian and compassionate claim before my Immigration and Refugee Board of Canada (IRB) hearing?my humanitarian and compassionate is in this situation:
  • We received your application for permanent residence on July
  • We sent you correspondence acknowledging receipt of your application(s) on September

To be honest with you need a good immigration lawyer advice
If you withdraw your H&c app you can apply for refugees why your worried now there is no removal for at less for six months

It depends. What are your grounds for applying for refugee status? Do you have strong grounds for a claim? My advice would be to consult with a good immigration lawyer before you do anything.

You have to be able to be able to prove that your life was at risk. I would seek the advise of a lawyer since asylum requests have serious consequences on extended families in if approved/denied and your family if denied. Don’t go back to the lawyer who recommended you leave your country and good jobs to claim H&C.

  1. We received your application for permanent residence on February 7, 2020.
  2. We sent you correspondence acknowledging receipt of your application(s) on February 13, 2020.
  3. We sent you correspondence on February 13, 2020. If you have not yet provided the information or the requested documents, please do so as soon as possible. Please wait until you receive the correspondence before sending us additional information, as the correspondence will outline all information that is required.
1, The correspondence on feb 13th is for biometrics, is this normal?

2, Now that Covid-19 put jobs on hold, will this affect my H&C?

H&C is a very long process. It takes 3 years and could take longer with covid. It is unclear how you currently have a work permit and whether it will continue to be renewed.

1. Yes this is normal.
3. yes covid 19 is likely to delay your application but is already Very long at around 3 years and you are at the begin of the process. Hopefully it won’t become much longer than 3 years but that is impossible to say.

I am not sure why you applied for H&C but the approval rate is not great In general.

Yes it is normal
All officers are still working individual and are working from home if your case is in process then good, so you will hear something soon if any one applied last month or now . Their case will be on hold and wait for further notice

Most officers can not work from home due to privacy reasons. Some work continues but most of these applications contain very sensitive information and require communication with various government organizations in Canada and abroad. This was not a planned absences so most do not have secure internet communications from home. Things like applications are likely not able to leave the office. Some work continues but it is unclear how much can be done from home. Some will be still working in the office. You should anticipate delays.

“Processing” doesn’t indicate how much work is actually be going on behind the scene. Just means that the process has started.
