I was a student in Canada and my extension with restoration was refused. I had to come back to my home country after and now I am in India. After I came back I worked full time as an intern in a bakery. I am looking for a job simultaneously. Its not easy to find jobs right now considering economic/political issues in the country. Businesses are closing down everyday and job candidates are being considered not based on qualification but other factors. I am not sure how things would turn out in future. I am making a strong application for a Study Permit for May and so far I have all the documentation right. I do have a insight of what I will do after I come back to my country, I will mention that in my explanation letter for the officer.

My concern is demonstrating ties to my home country. I have my family here, my brother and my mother. My father passed away 2016. I would like to know how would I demonstrate good ties to my country so the officer won't refuse my application thinking I wont come back after completion of my studies. I know I will have to show it how and why rather than just saying that I will come back.

How long ago did you return to your home country? Based on your posting history, you had an overstay and also applied for a TRP and subsequent study permit that was refused. So you will have to likely demonstrate quite strong ties to be able to return.

One very strong recommendation is to wait a year or more since the time you returned to your home country before you try applying again. How long has it been? If you apply quickly after returning, this will reinforce that you lack ties.

Ties are typically things like job, property, assets.

I returned around 3 months ago and I will apply for May. My lawyer said to me it should be at least 6 months before I can apply. I would like to add, when I called immigration after the refusal and I also let my local M.P call immigration, they told me why was it refused and they also said they are ready to accept the study permit application again and view it if I apply outside of Canada. I wonder they didn't mention anything about ties or any other issue around my situation. Also, I am not sure how would they react to my overstay.

In our previous conversation you advised me to apply with a strong study permit application and if it doesn't work I can get eligible for express entry and apply for PR. I am considering your advise so far but I wanted to get the ties part clear too, so I posted this one.

In my opinion applying in May will be too soon given your history in Canada. But that's obviously your choice. You will definitely want to demonstrate very strong ties. Again, this is things like employment, property, assets. It will be more difficult for you to demonstrate ties since you only recently returned from a long stay in Canada.

What does your lawyer say about demonstrating ties? What recommendations has your lawyer made on how to do this?

she haven't said a lot about ties. She said I should be undertaking activities related to my study program in Canada so I started working as a baker after one week of my return to India. She spoke more about how I need to explain the circumstances which led me to take decisions in the past and show the officer how I fixed it for a successful come back for Canada. She said I could mention I will open up a business after coming back.

That's all I can remember what she said to me in terms of ties.

I would ask her in that case. If you are paying for advice she should be assisting you in putting together a strong application.

Good luck.
