FSW-Outland candidate from Pakistan

AOR: 20 Sep 19
Med passed: 1st Oct 19
Biometrics: 4th Oct 19
ADR: 23rd Jan 20 (below extracts)

"We have begun processing your application for permanent residence, and in order to make a decision we require the following information/documents:

 CV/Grad Kit: Please provide your updated CV/Resume and complete the enclosed table. This must be received at this office by: 2020/01/30  Schedule A: Please provide A separate and newly completed Schedule A Background Declaration form (IMM 5669) bearing an original signature. This must be received at this office by: 2020/01/30

Please note that the requested information/documents must be received within 7 days from the date of this correspondence. Please upload these documents to your MyCIC account.

If we do not receive the information/documents within 7 days, your application will be assessed based on the information we have on file, meaning your application could be refused as incomplete. "



Questions:

1. Why do some people get a month or so for ADR and I only got 7 days?

2. Is it true some peoples ADR says " we require documents for further processing " , if mine says " documents required for decision" , does that mean anything different or are both the same?

3. Does this ADR mean I should buckle up for 6 or more months ?
1. CIC calculates the number of days based on the documents they are asking. For eg: if they are asking for PCC they normally give 30-60 days based on which country's PCC they are asking because they are also aware of the time required to get those documents. In your case you can fill out those form within a day and submit hence they gave you 7 days.
2. There is slight difference between both but in most cases the documents they are asking are for either required for eligibility or background checking. In your particular case MAYBE the rest of the documents are okay and they just want to confirm it before the take the final decision.
3. No there is no definite answer to that question sometimes people who submitted ADR got their golden email within span of few days while some took weeks. Each case is different and it is dependent on number of factors. At the most you will have to wait a month or so...

@legalfalcon I have applied for Canada PR on sep 2019 and awaiting my PR. I am planning to buy a house here in India with Home loan.. Can I I take home loan if I have applied for Canada PR? Will it affect my file?? As I am planning for it now I didn't have any documents for this at the time of filling will this be OK? Will taking load creat any problem for the file?

You can surely take a loan, but will still have to meet the PoF requirement when you land.

Hi All

Here's an update on my PR application. Received the email to submit my passport yesterday. Given below are the timelines:

Passport request email - Jan 24th, 2020
Primary office - CPC, Ottawa

My husband already had a PR visa, but is living in India. I applied for an express entry visa individually and declared husband as "non-accompanying spouse" and provided his PR details in the application. My overall CRS score was 471. Both I and my husband had to get the PCC done for the application process.

Also, I had all the requisite documents except the letter from employer with job description (which my employer refused to provide). Hence I submitted a notarised document signed by a senior colleague with these details, along with supporting evidences such as Email from HR refusing to give the requisite letter, letter from the company with employment details such as DOJ and designation etc, and the pay stubs.

I hope this information helps.

I have a Law degree and I claimed points for a First Professional Degree but WES assessed my degree as the equivalent of a 4 year Bachelors degree. I read on this forum of Lawyers that did what I did and they got PR. I also contacted IRCC on their Facebook channel and they confirmed they will assess my degree as a FPD even though my ECA states otherwise.
I think it's an unfair decision. I explained in an LOE what I did and attached my conversation with their official Facebook page and what IRCC says on their website about Law degrees.
Can I appeal or would you suggest I reapply?
IQAS isn't assessing degrees for immigration purposes till May and I don't know of any other body that assesses law degrees as First Professional Degrees.

Since you have a law degree, you should be aware that there is no provision of appeal against the decision of an administrative agency. IRPA only allows for judicial review of the decision of the an administrative body.

However, before you think of JR, you can definitely request reconsideration. The Fed Court in Lim v. Canada states:

[23] More importantly, the cited grounds to exercise discretion to re-open were arbitrary and unreasonable. The only basis upon which a case would be re-opened is if the department deemed themselves to be in error. That ground takes no account of other factors such as Acts of God, unforeseen circumstances and matters beyond anyone’s control. It is a self-serving and ludicrous basis from which to reject a re-opening request and is hence arbitrary.

[24] It is an unreasonable basis because it lacks reality, common sense and fairness. As put to counsel, the Respondent would not re-open even if it knew that the letter was destroyed in a fire in the department’s offices because officials had not set the fire. It is a breathtakingly unreasonable position.

[25] The refusal to re-open decision must be quashed. [emphasis added]

Do PCC's have an expiry date? I have one from the UK and I'm wondering if in the event I have to reapply, I can use the old one or if I should get a new one? @legalfalcon
If there is a expiry date mentioned on PCC then you need to reapply for it. However if you were staying in UK for a period of time and then left the country and the PCC you took is after the last day you were present in country then it is valid as per IRCC laws. I will send you the link for PCC's in short while.

The PCCs have to be valid on the day when you file your application, just like any other document. Once filed, you need not worry about their expiry.


As per IRCC:


  • For the applicant’s current country of residence, the police certificate must have been issued no more than 6 months before the submission of the e-APR.
  • For countries in which the applicant no longer resides, the police certificate must have been issued after the last time the applicant stayed in that country for 6 months or more in a row.
  • Police certificates meeting the above requirements can be accepted even if they have an expiry date that has passed.
  • This includes the requirement to provide a police certificate for countries in which the individual has travelled for 6 months or more in a row, whether or not the individual had an established residential address during this time.
  • Police certificates are required upfront and are mandatory for each country (except Canada) where an individual has spent 6 months or more in a row within the last 10 years. The individual does not need to provide one for any period of time before the age of 18.
