Hello Everyone,

Looking for yours seasoned advice about my candidature for PR application

Background Scenario:
1. I'm currently working in Canada and having Open work permit till 30 May 2020
2. I got Married last year and my wife also received open work permit with same expiry date and she also doing job from past 2 months
3. I've created My express entry profile mentioning not Accompanying spouse(If I mentioned my wife as accompanying spouse then my point tally dropped to 468 below the cutoff marks of 469).
4. My birthday is in March and my point will further reduced by 6. At present my CRS score is 471.

Current Situation: I've received ITA yesterday

Question:
1. Can I proceed with Non accompanying spouse application? considering my spouse already in Canada and having open work permit till 30 May, 2020.

2. when can I sponsor her ? once I received my PR and I'm already working in Canada.

You need to be honest in your letter of explanation and explain that your spouse is non accompanying due to points, but is in Canada, and if you are granted PR you will sponsor your spouse.

A non accompanying spouse requires an explanation. There is an existing case on the forum of an applicant receiving a procedural fairness letter due to a non accompanying spouse in Canada. Be clear about what you are doing and explicit.

IRCC seems to accept non accompanying spouses due to points, if you are clear and up front about it.

Yes, it is better to be honest. If you can substantiate your reasons for her non-accompany. The immigration support staff may advice or go ahead with the process. If you do otherwise, and immigration confirm you gave false information or left out important details, they can: refuse your application, find you inadmissible and/ or bar you for 5 years from applying to come to Canada for any reason. My advice is that since your score is going to be less than the lowest score in your round of invitations if your partner is to accompany. Rather than decline the invitation, you should try to improve your score and update your EE profile.

Thanks for response, In my application I've mentioned that married and Spouse details mentioned in regards to country of residence CANADA. Will include further explanation in LOE

I'm the one that got PFL in the same situation. I'll update in my thread once I hear from then. Got PFL on Dec 19, responded on Dec 21, no news yet. Good luck.

Hello Dear,

I initially mentioned that my spouse have not decided yet for her long term commitment to live in Canada. If she will change her mind then I’ll update my application accordingly....however, I withdrew my profile and apply again because draw points drop and I can file alongwith her in my application. ....reason I mentioned earlier is correct and you can explain it if they ask
