Q 1) Is it possible for me - the dependent on the application, to land 5 months after the primary applicant has landed? (Medicals valid till Aug)
Yes, The primary applicant has to land first, or along with the dependent applicants. Dependent applicants cannot land before the primary applicant lands and is admitted as a PR. However, there is no requirement of all the family members to and together. As long as the primary applicant lands and is admitted as a PR, the dependent applicants can land anytime after that, at any port of entry before the visa expires.. Q 2) I am worried that the funds not being in my name could pose a problem for me as I believe I am required to prove to the immigration officer that i meet the minimum requirement for pof. Is it okay that the funds are not in my name or my bank account but in my wife’s (primary applicant)

Thank you for all the advice you provide to this forum. It’s very useful in this times when we feel helpsless.
I would like to have your opinion, my hubb and I been waiting for 20 months. We sent the web form and got nothing, we’re still waiting for that response. Nothing changed until today when We reached CIC through call and later on the afternoon we got a letter saying:

“It has been determined that you meet the eligibility requirements to apply for permanent residence as a member of the spouse or common-law partner in Canada class...”
We appreciated the news after a very long time without getting a single sing, but I thought that, that was like stage 1 of the application and we were already elegible.
Does this means we still need to wait a few more months? My medical exam is going to have 2 years in begging January.
We will appreciate your opinion.

We submitted our first medical exam in may 2017 which we submitted completely along with x- ray. Now they have asked for medical exam again in November 2018 but this time my wife who is the principal applicant is pregnant. We might not be able to upload xray for her. So my question is that will they still put our application on hold till we will be able to upload her x-ray, even though they took so long in processing already.

Yes here it is:

I received ITA in oct oct first week. Balance in my account was 1 lac on that day. My oct monthly salary was higher at approx 4.5 lacs and my nov salary wud wud be higher at approx 3 lacs. my regular salary is 1 lac.This higher salary is driven by RSU vesting in these months ( part of employment). my bank account shows high entries as follows -

Oct 20 - 3.5 lacs
Oct 31 - 1 lac
Nov 20 - 2 lacs
Nov 30 - 1 lac

i have a document from morgan stanley (US Broker) stating USD value of RSUs sold. Bank statement has just an entry in INR. what all prrofs shall i show to confirn this is my money?

Also, i wont hv good enough average balance - would that be an issue?

Good evening, i have couple of doubts in filling my personal history section. I am planning to submit my application next week. Please advise.

1) In USA, there was an issue with my university, and my F-1 student reinstatement petition was denied. I returned back to India with in 30 days on my own. No proceedings have been initiated against me, but was told in the denial letter that i don't have a lawful immigration status and required to depart US or else file motion to repeal in 33 days. I left on my own within 30 days. I have mentioned about this denial in statutory questions and also in Schedule A form. So what should i write in the status section in USA? Is writing out of status okay for this 30 day period?
Note : This education activity is incomplete and not part of education history.

2) I have an employment in US on a H-1B, where i worked at the client site. The employer ran payslips from his location, and not from my client site or my residing address (Different US state from employer's). Also, i was unpaid for 6 months. I left USA on my own before the H-1B visa expiry date on my passport. I never received any notice from USCIS or from my employer regarding my H-1B cancelled or ordered to leave the US.

a) Is it okay to write activity as unemployed for this period and still mention my employer name in Name of employer field, and write in activity description, my job title and unpaid in brackets and status for this period as H-1B? Or should i write as employed and write unpaid in brackets near job title? Please suggest.
b) Also since my employer ran payslips from his location and not from where i worked and resided, will it cause any problem?
c) I mentioned in addresses history, where i worked and resided accurately. Do i need submit my address or employment proof like utility bill or driving license or pay slips or tax returns for this employment?
d) Even though no points are claimed from this employment, should i explain all these details in my LOE or is it not needed?

Note : This employment is not recent and not part of work history and am not claiming points for the same.

I am aug 23rd aor..med/ip1 18th sep/rprf req/paid-2nd/3rd oct..

I hv yet not moved to ip2.bigger worry is as per cic agent last week..my eligibility is yet not met..thou she said file is normal..no negative comment/ adr seen

I feel if the eligibility is req required, wic m not sure, it might b bcoz of pof.

I had shown 20000 cad ( req for 3 is 19100 cad) @53 inr.. but cad reached 57 inr in oct'18..hence as per 53, m approx 900 cad surplus but with 57 m 600 cad short..
I hv ordered notes last week wic i wont get bfdore dec end..shud i send updated pof before hand?

Also, in my initial pof 8lakh was fd n 2.5 liq cash..fd maturity was 31st aug 2018..just week post aor..but after submission of application i renewed my fd..so now the maturity is aug 2019

Will next yr's maturity date b a prob if i send updated pof?

Please advice..thanks

Only the primary applicant has to show that they have the PoF. If you are landing together, even if the PoF is in the spouse's name, that will suffice.

You can produce the same documents you submitted with your application to show you have met the PoF, or you can show updated documents.

If your spouse is pregnant, then the X-ray will be deferred as per what the Panel physician recommends. Your application will not be put on hold, but will proceed as usual. IRCC has protocols i place when dealing with applicants who are pregnant.

IRCC is only concerned to know that the funds are your and that you can use them. you can provide a bank letter as per the IRCC format that will provide the account balance, when the account was opened, and the average balance for last 6 months.

Then you can explain it in LoE along with the proof of where the funds came from, i.e. the document from Morgan Stanley. This would be sufficient.
