i want to take my mother to canada, she’s in the US out of status for long time. Can i sponsor her from the us without the need to go back to her country of origin? Or she need to go back to her country before i sponsor her? Can i sponsor her even i just sponsored my husband?

You can sponsor her provided you meet the minimum income requirements and provided you are selected in the annual lottery. The lottery will next open in January.

Your mother can be sponsored while she is out of status in the US. Make sure you are 100% honest about her immigration history in the sponsorship application.

Note that once she leaves the US, she will be banned from re-entering for 10 years. So if you sponsor her for Canadian PR, make sure she is prepared to leave the US for a decade and not return.

Thank you for the reply. Based on my understanding in order to sponsor her i need to meet the minimum income in 3 previous years, right? If not, can my husband income help me with it?.

Yes - you need to meet the minimum income requirements for the past three years in order to qualify to sponsor a parent. You can only use your husband's income one he is a permanent resident. Only income he earned in Canada can be counted - income earned outside of Canada cannot.

Also the lottery takes place in January and it takes 1-2 years after you submit application to get approval. Unfortunately it will be 2 years at the very minimum for you to bring over your mother. Also if your parents are still married and your father is alive you have to sponsor him too even if he doesn't intend to move.

Oh i see... so maybe super visa is better for now.
 
I don't think she'll ever be approved for a supervisa due to her long overstay. They'll think she'll do the same thing in Canada. I think your only option is to sponsor.
 
Yeah you are right, but what if she go back to her country of origin before she apply for super visa.

Agree with above. She has no chance of a supervisa because of her US overstay.
