Hello everyone! I have been reading the forums for a few months now in preparation for sponsoring my soon to be spouse, but we are facing a situation that i don't know if it might affect our application, therefore i am reaching out for any help possible since i don't have any experience.
We have been together for 1 year and are very very happy, however, she is from japan, and is currently married, and divorce there is very difficult. She has been living separated from him and trying to file for divorce for 4 years now with no success but has finally come close to obtaining it since the guy has agreed to payment in exchange for divorce. She is planning to come here right after signing the divorce papers and we will marry and apply for sponsorship right away.
I am seeking for any help and information on this manner if anyone can give some input. Are there any complications that we could be facing?? Would we need additional paper work? Would it be a good idea to get a lawyer? I think we could do the basic paper work ourselves but would it be safer to get one? Any information would be super helpful!! Also, we were thinking of doing an outside application, but she would be living in Canada as a visitor while the process is going on. Her visitor visa would be valid for 6 months, so we would have to figure out a way for her to stay as a visitor for the 1 year, do you guys have any recommendations for this by any chance? Thank you guys in advance so much. We love each other and are doing our best to make this happen!

Hi

You don't need a lawyer. Your situation isn't that unusual.

She can apply to extend her visitor status. With proof of finances and proof of the PR app, there should be no issues.

Hi I've been meaning to ask...what would you consider to be the minimum acceptable proof of finances?

Thank you for the response! I was also wondering if you know. For her to get re-married, we need the divorce certificate, and do you know by any chance what else would she need? Because I assume it would be different from a regular marriage.

Generally, it's good to show a few thousand a month but it really depends on the situation, i.e. how much your expenses are.

No idea.

How is it different from a regular marriage?

I'm not sure, but if she is divorced, she would be re-marrying, so I was just wondering if she needs extra paper work or something extra to fill out other than having the divorce certificate?

Do you have any idea how many divorced people remarry? It's not an unusual situation in any sense of the word.

She needs her divorce certificate to prove that she is in fact free to marry. Other than that nothing special is required. Check the requirements in the province in which you plan to marry to see if there's anything they require. (I've been divorced in Ontario and remarried in BC and now divorced in Australia but getting married next year in Ontario)

Thank you! Actually we will be re-marrying in BC, did you only need the divorce certificate? Or was there some extra paperwork or sheets to hand in with it as well?
