i dont understand why the tie breaker rule is so confusing to many... who ever above the cut of ll get ita... who all have crs equal to cut off.. tie breaker will be applied.. it is as simple as that... :)

* CRS > cut off -> guaranteed ITA
* CRS = cut off -> tie breaker rule applicable

How about CRS>cut off and there's a tie and the number of ITAs for that particular draw have been met?

I am not saying that they will not get an ITA. I said that there's a thin chance of not getting an ITA because of the Tie breaker rule. Whatever you said in your posts is correct except the CIC example mentioned on their website. Their example is correct as well, they have applied the FIFO rule and the whole pool is organized by the tie breaker rule now.

Tie breaker rule applies to each applicant at or above the CRS cut off.

New approach to rank candidates with the same CRS score
We can now break ties between candidates with the same rank in the pool.

The Express Entry system ranks candidates in the pool by their CRS score. In case of a CRS tie, the system will then rank all tied candidates based on the date and time that they submitted their profile.

For example:

The highest ranked candidates are invited during rounds of invitations. If we issue 3,500 invitations during a round, the system will pick the top 3,500 candidates at that time. The cut-off for the round is set by the CRS and submission date of the 3,500th candidate. It could look something like this:

Rank CRS Profile submission
(Date and time)
Status
3498 422 October 14, 2016 at 20:40:56 Invited
3499 422 February 5, 2017 at 11:32:01 Invited
3500 422 March 27, 2017 at 08:12:23 Invited
3501 422 March 27, 2017 at 9:54:39 Still in the pool
3502 423 June 3, 2017 at 22:57:12 Still in the pool

Note, if you update your profile, the system will keep the original date and time stamp when you first submitted your profile. But, your profile will have a new time and date stamp if:

  • you choose to withdraw your profile and create a new one instead or
  • your profile expires and you submit a new one
The example mentioned by CIC is wrong with respect to rank 3502.
An applicant with CRS 423 (submitted on any date/time) would still have a rank of 3497 or better compared to the oldest applicant with CRS 422.

See corrected example below when CRS cut off is 422 and Date/Time is March 27, 2017 at 08:13:00.

Constructive criticism is good.

I know very well how the express entry system works.
Please check the example mentioned in the above post.

Hi all! I need some legal advice urgently. Is there anyone on this forum, who is an expert at the law component of the immigration requirements? Thanks!

Since 5 applicants were stuck on CRS 424, they were ranked based on their profile submission date (Rank 3488 to Rank 3492).
Since 5 applicants were stuck on CRS 423, they too were ranked based on their profile submission date (Rank 3493 to Rank 3497).
Since 5 applicants were stuck on CRS 422, they too were ranked based on their profile submission date (Rank 3498 to Rank 3502).

So whatever be the case, an applicant with CRS 422 does not get ranked above an applicant with CRS 423.

I agree with this. this is the most logical explanation but please try to understand what my point is.

There's a possibility that there's a tie between applicants with higher CRS score as well. What would be the treatment for such applicants? Wouldn't they consider tie breaker for them as well?

If the CRS is greater than cut-off how can there be a tie? If my CRS is greater than cut off CRS, am i going to end up in a tie with someone who has a lower CRS??? lol ... you cant wake a person who is pretending to sleep ... :)

Clear now.

No more questions left. :)

No buddy, I am not comparing the score with lower scored individual. My question is about the same scored individuals > CRS, wouldn't they prioritize them according to their profile submission date?

No they wont have any issue... since they are above the cut off... and their tie is not a concern for CIC. :)

It is about a case falling in the domain of financial misdemeanor and its impact on immigration. If there is anyone here to guide then I'll really be eager to send message privately. Thanks once again!

You can ask "Legalfalcon", there is a thread called "Thank You Legalfalcon", you can post your query over there, he is quite regular to answer questions and got deep knowledge about IRCC laws.
