Yesterday my common law Boyfriend's application was returned because of my (the sponsor) lack of supporting documents on my work/financial history. This was my failure to include my recent notice of assessment with total income, proof of income statement or I had to include a letter of explanation. I thought I had provided ample information to prove my financial status. I own my own successful business, I had included a letter explaining my situation, I included my T4s for the past two years, my incorporation documents stating I was the owner and even a letter with my company's asset. I had asked my accountant for this information and I sent exactly what was forwarded to me. I thought I was extra careful and am devastated as I feel like I overlooked a specific document which was crucial to this application's success

My question now is: my boyfriend working holiday visa expired (he's had two) a few weeks ago and he was on implied status as his PR application was going through. Now that it is had been returned and not placed in the queue, what happens now? I have been reading online all morning and it seems as thought the next step is the Restoration of status. Is that the best way?

If anyone can help in any way I would be so grateful. I really thought we had submitted an excellent application and I am so sad that I missed something so simple.

Yes, he is now out of status and must apply for Restoration.

I have been reading different forums all day. Essentially now, he has to apply for restoration. does anyone know how long this takes? what about an open work permit with his new application? would that work?

He needs to apply for the OWP and select the Restoration option on that application. It isn't a separate app.

That's better news...so we can re-submit our application for PR with a OWP with restoration and we explain why his visa expired but his is still within the 90 days. He looses his implied status to work but he still can apply for an OWP and PR even with this first returned application.

Yes, that is what he needs to do. As he was on an IEC, he didn't have Implied Status as a worker; it was only as a visitor.

I am going to see a lawyer tomorrow as well. Thank you for all your help. Another question are we able to file for another application for PR and an open work permit with restoration at the same time?

No point in wasting money on a lawyer. Just resubmit the inland PR/OWP app with the extra documents.

Edit: I assume that the returned app was an inland app with an OWP included? Applying for PR on its own doesn't grant status.

Yes, it was in an inland PR app under common law partnership as well an application to change conditions of his work permit and now his working travel visa permit has expired so he would need to apply for Restoration. I am reading lots of information but still confused. Can we resubmit for PR with an OWP and select the restoration option on the button...

Hi,

If you don’t mind, May I please know the reason why you were not able to send the Notice of Assessment. I am also in the same situation, my NOA for year 2018 is still under review. I wrote a letter explaining the reasons and also about my current and previous employment history and my financial status. I provided a screenshot of my CRA account showing that’s it’s under review, plus I have attached NOA for year 2017, T4 for 2018, paystubs and original employment letter with current paystubs . I sent my application last week. Do you think it will be an issue. I thought to wait but as it was clearly mentioned in the checklist that if We are not able to provide recent NOA an explaination to be provided. Anyone with knowledge on this please comment. Thanks
