Can My Wife Sponsor Me Immediately?

Thanks you for your opinion. We got married after she did her first landing in Canada. However her PR card was issued after our marriage because CIC had issue with the pictures' dimensions. We were not married at the time she sent the new pictures. All this happened in April 2016 and we got married in August 2016. As my wife's PR card was not issued till March 2017, so she applied for PR travel document in January 2017 and at that time she provided her marital status details to CIC. We have not started our application yet so no medical or anything I have gone through.

One more question I want to ask you guys is about her income. Does she need to show certain amount of income before filing my application or she can file it without even a job ?

There are no income requirements to sponsor a spouse. Provided she's not on social assistance, she can sponsor you immediately. Ignore anyone who tells you she needs to wait five years. This is incorrect.

Thank you very much scylla... Which option would be better Inland or Outland. For inland I have to apply for tourist visa first and I have got my student visa requested refused last year. Will this refusal have any negative impact on tourist visa application?

Yes - your refused study permit plus the fact you have a wife n Canada make the chances of the TRV being approved quite low. I would personally apply ouland as soon as you can.

Guys I have another question about hiring an immigration lawyer for my sponsorship. Is it useful to hire a lawyer or would it be okay to file my application on my own?

Also in the checklist, they ask the sponsor about their financial position or plans to take care of of sponsored spouse. What would be the best response to this question provided that my wife has just moved to Canada and she is not doing job right now. Should we wait till she finds a job or is it okay to file the application without the job?

Do it yourself. Your sister in law obviously has a pretty good grip on what is required since she sponsored your wife. Read the instructions, follow the checklist. Check for form updates. Have someone double check before you send it. Ask questions on here....loads of excellent advice...and save the money.

Hello guys! I have another question that I need your help with. The thing is that my wife landed in Canada first time in Jan 2016 and then she came back to her home country after a month. Her PR card was delayed because of Pictures so she got it in 2017 March or April which was delivered to her by her parents. After 1st entry she went back to Canada in mid of July. Yesterday she went to a tax return preparer who said that she had not completed 180 days stay in the country so she should submit her tax returns as a non resident. Then he said if she wants to sponsor her husband then she should submit returns as resident, as no one checks the file properly. Now the questions is if she should submit her returns as resident or non resident. Does it really make difference? If so then should she wait for 180 days before submitting my sponsorship application or it won't be an issue to submit the application now without waiting for 180 days? Please share your opinions and experiences.

She will have to stay in Canada for the duration of the processing, but the fact she wasn't a resident for a while won't matter. In any case she should not lie. She got her PR card in April but after getting PR card her first visit to Canada was in this July. But thank you for clearing that it is not necessary to stay in Canada for 180 days before submitting application.
