This is what the letter from cic says....we are pleased to advise you the your final determination for pr interview has been scheduled july 14. ....so im not sure if this is a landing or just a interview. I cant get thru to cic. Any ideas?

That's a landing. DM will eventually come (the letter anyway). But that's definitely a landing.

yes, application received at CIC April 2016, got DM on the sponsor side over a month ago, the applicant side still just says "application received", has been no change since then, got our hopes up when it seemed like things were rolling along sequentially a couple months ago, and then all of the sudden it seems like they stopped

Either works. Processing time is still probably 4 months.

That said, IMHO, it's probably a waste of money. Yes you'll get implied visitor status when you apply. But when you have run out of status, you're case is processed under public policy... Therefore, you have been given the provision that they cannot refuse to grant a PR solely because you have no status.

On top of that, your OWP must request Restoration of Status. That is an extra $200 on top of the $255. You cannot work until they approve it. It is possible that you may have finished processing and land in that time. It's unknown if you can get that money back.

I am a bit confused. Didn't you mention last week about divorce certificate being required from Hong Kong?

Hi profiler,thanks for the reply..I sent my app ytd by mail,but about the fee my lawyer told me I just need to pay $155+$100..I didn't pay the restoration fee..is that will be a problem for my app?or I can just pay it after when they request it?
About the divorce I still finding a solution

just over a month, but no email or anything else, just the words changed to "Decision Made", if I click on the Decision Made thing what is inside hasn't changed, and on the applicant side it hasn't changed at all

It's normal. Means they are likely doing the security check.

Were you out of status? If you didn't have status, then they will either return your application to you, or demand the restoration fee. Let your rep work it out -- that's their job.

WRT the divorce, frankly, I am f*&^in' floored. Just flabberghasted. How??? How did they determine that you should have AIP?? If he is still married in Hong Kong, that means you cannot be a member of the family class...

Anyway...

(9) A foreign national shall not be considered a member of the family class by virtue of their relationship to a sponsor if

• (b) the foreign national is the sponsor’s spouse, common-law partner or conjugal partner, the sponsor has an existing sponsorship undertaking in respect of a spouse, common-law partner or conjugal partner and the period referred to in subsection 132(1) in respect of that undertaking has not ended;
  
  
• (c) the foreign national is the sponsor’s spouse and
  • (i) the sponsor or the foreign national was, at the time of their marriage, the spouse of another person, or
    
    
  • (ii) the sponsor has lived separate and apart from the foreign national for at least one year and
    • (A) the sponsor is the common-law partner of another person or the sponsor has a conjugal partner, or
      
      
    • (B) the foreign national is the common-law partner of another person or the conjugal partner of another sponsor; or
• (c.1) the foreign national is the sponsor’s spouse and if at the time the marriage ceremony was conducted either one or both of the spouses were not physically present unless the foreign national was marrying a person who was not physically present at the ceremony as a result of their service as a member of the Canadian Forces and the marriage is valid both under the laws of the jurisdiction where it took place and under Canadian law;
  
  
• (d) subject to subsection (10), the sponsor previously made an application for permanent residence and became a permanent resident and, at the time of that application, the foreign national was a non-accompanying family member of the sponsor and was not examined.

thats still in the timeframe right now.. we've seen many receive it after 8 weeks..of course others much less but not to worry yet. You will be completely over soon. I'm late April and I have neither SA, AIP nor DM yet. We've seen many whos had none and went straight to landing interview email too.
