Clarification on open work permit for spousal application

Just apply for the visa and follow the instructions. I'd forget about the 'dual intent' stuff - won't help you in applying (in my opinion) - it may be useful as a term at some legal stage but you'll want to avoid getting there..

You'll disclose during this that you have a sponsor ship application in process and refer to the family reunification policies for family sponsorship. (You can search for htat).

Otherwise echo the points above - if she has an ongoing right to reside in Belgium, that's a plus.

I'm not aware that you'll need to show that anywhere, frankly. Perhaps at the applying for a work visa stage (once arrived in Canada), but I'd put that as low priority until she has a visa.

If you do, the common basics will be sufficient - having her added to a lease would be ideal.

If you can add her to your lease, that would help. So would things like adding her to your insurance, making her joint on your bank accounts and credit cards, etc. (All things to be done only after arriving in Canada of course.) There's also a document you can get - https://www.canada.ca/en/immigratio...ication/application-forms-guides/imm5409.html - that you fill out and then take to a notary public in Canada to sign together and get notarized (I used red seal notary). Note that this last one is for common law - i dunno if you can get it signed beforehand or if you need to actually wait the one year (in my case it wasn't needed until after i'd already past the one year mark).

Since they have already applied for PR as family class/outland, they are either married or have already demonstrated what's needed. So this is mostly overkill in this context - at least until determined for what exactly the evidence of joint residency is needed. Figuring out how to prove it until to whom/for what is cart before the horse.

Ah right, those are really good points on two counts: typically they only want the proof of living together if common-law or otherwise unmarried, as a marriage certificate is on its own considered very strong proof and evidence and documentation of the relationship (though i'm sure some basic additional things will still be asked for just to help ensure it's not a fraud marriage).

And you're right on the other point - when I did this, it was to add a common law partner to my existing PR app - that was the stage I had to get all these docs ready. But this OP is already past this stage, it sounds like.

Yeah, I missed that OP was explicitly stating what documents would be needed AFTER op's spouse was in Canada.. but not sure who would even be asking at that point for that kind of stuff.
