I just finished my refugee hearing and am currently waiting for my NoD. My boyfriend is a US green card holder, and we’re planning to get married later this year.


Our biggest concern is that we really want to live together, but we’re currently in two different countries. Once I receive my NoD, I plan to submit my PR application right away — but I’m not sure:
Am I allowed to leave Canada and live in the US with him while waiting for my Canadian PR to be processed?
Or am I required to stay physically in Canada throughout the entire process?


We’re trying to find a legal way to be together during this time without putting my PR application at risk. If anyone has been through something similar or has advice on how to avoid being separated for a long time, I’d be so grateful to hear from you. Thanks in advance!
 
First off all you need to get your RTD and US visa in order to enter that will take all the time. Nowadays it’s taking over 2 years just for a tourist visa appointment for US . I don’t know if you have some kind of visa exemption. Then your question about staying out of Canada , RTD expiry will be 2 years, so yes you would need to come back to Canada in order to get a new one after the expiry. And even if you get US visa and entered US then to stay there permanently need you to file for spousal sponsorship green card application. So yes there are chances but you need to come back to Canada to show ties in order to get your PR application approved. IRCC might approve it thinking that you are in Canada but after you get P1/P2 emails from IRCC you need to be present in Canada in order to get your ecopr and then PR card. But in the process you need to provide your spouse information in you PR application and tell IRCC that he is a US green card holder. IT IS BETTER TO GET PROFESSIONAL LEGAL ADVICE IN YOUR CASE

If you haven't already done so, join a US immigration forum and do further research on the K1 and K3 visas to understand the process and processing times. Submitting your application does not mean you can move to the US while processing is underway. There are also pros and cons to the K1 vs K3 path which you will want to understand before you decide which you do.

You will be able to leave Canada under an RTD and provided you are granted a US visa. But again, please research the US process you will have to go through in details first.
