Unfortunately this is why it's extremely important to do research before making a big decision to try to come to another country. Processing times for asylum cases can be very easily accessed online through the IRCC web, along with detailed information about the process.

Anyway, not much you can do about that now. You will have to decide if you proceed with your asylum case or make the decision to leave Canada.
i get it and its a tough decision i run out of options though. basically if i go back to usa i am going to be deported and if i go to my country of origin i am literally going to be persecuted.
i know my case will be approved once i am given a date in court . its just the waiting times that are very long . i get very few money from government and shelters are not suitable yet i haven’t received my work permit yet after 2 months .

Realistically may take longer than 2 years for a hearing. The backlog is close to 300k cases with the ability to process closer to 50-70k cases a year. Asylum is really meant as an option for people when their life is in so much danger that not being able to return home is an acceptable option. You are the only one who can determine what is best for your life. If you continue with your claim you should be prepared to not be able to return to your home country for around a decade. There is the option to visit family in a 3rd country if/when your asylum claim is approved.

Think the bigger issue is whether you actually qualify to apply for asylum given the US asylum refusal.

Your case should have been referred to IRB, did you have an eligibility interview with a border officer? Have you disclosed a prior refused refugee claim?
in Canada i never applied for Asylum . i only applied in the usa during Hilary clintons administration and got rejected . i am in Windsor right now and always go to immigration office to sign in every two weeks meanwhile waiting for my work permit

Just please be aware that there is never a guarantee that your case will be approved, no matter how strong it is. There is always some chance of refusal.

Hopefully you will get your work permit soon. In terms of the decision of whether to remain in Canada or not and proceed with the refugee claim, that is only a decision you yourself can make.

All of us here would agree it is not an easy process. This is why doing research before coming was so important. Then you would have known in advance what to expect and would have been much more prepared.

It's not for a lawyer but a border officer to make that decision. The lawyer can overpromise you anything. What documents did you get when you left the border? Conditional removal order, BOC?

BTW - There was no Hilary Clinton administration. She was never President. Maybe you mean Obama's administration?

Very rare for I assume you mean the Secretary of State to be involved in asylum case results. The fact that you have not been in your home country for likely over 15 years also can create issues when claiming asylum. You were already refused asylum in the US which should make you ineligible to claim asylum in Canada and is one of the many reasons your situation is quite surprising.

Usa makes business with my mothere country. if i was denied there for pilitical reasons it doesnt mean my case isnt strong.
my daughter is american though

canada is advertised to be a heaven on earth . but once here i realize too much bureaucracy and endless paperwork . also the shelter i was refered to is full . still waiting on work permit. i am 60 and sleeping in my car i came with though they wouldnt let me work even though i have a driving license.
i checked and social assistante is just 700$ i dont know if i can survive time will tell

Ultimately you need to make a decision if you are going to remain in Canada knowing the long processes times for refugee applications and knowing the outcome is uncertain. That's your next step and this is a decision only you can make.
