Hi all. I am new to this thread. Need some advice, please.

I am a Canadian citizen and I have sponsored my parents to come to Canada in the past. They only lived here for less than a year and went back home. They do not wish to ever come back to Canada. This all happened after I divorced an abusive husband who my parents preferred over me. This husband was a co-signer in the sponsorship. Fast forward, I have now moved on and met someone who is not yet a permanent resident. I wish to marry and sponsor him, but I don't know if I would qualify because of having sponsored my parents. He also has a 3 yo son who does not live with him. My questions are:
- having sponsored my parents, I know I am liable for them for 20 years from the start of sponsorship (and so is my ex-husband). Would this disqualify me from doing a spousal sponsorship? How much do I have to make to be able to sponsor my future husband? (I have one child who lives with me).
- do I have to include my future spouse's child in the process?
- can a parent sponsorship ever be cancelled in case of abuse from parents towards sponsor?

Thanks so much everyone and happy new year!

Did you sponsor your divorced husband OR were not sponsored by him? If so, WHEN?
If not, Yes you are eligible( qualified) to sponsor your future spouse as long as you meet other sponsorship requirements related to your case.

https://www.canada.ca/en/immigration-refugees-citizenship/services/immigrate-canada/family-sponsorship/spouse-partner-children/eligibility.html

In your case, financial requirement is the key. Since you will be sponsoring your future husband with his minor child who is his dependent. Probably you won't have to prove your financial ability.

Income requirement
In most cases, there isn’t an income requirement to sponsor your spouse or partner or dependent child. You only need to show that you have enough money to meet the income requirements if:

  • you’re sponsoring a dependent child that has 1 or more dependent children of their own, or
  • you’re sponsoring a spouse or partner that has a dependent child, and their dependent child has 1 or more children of their own.

https://www.canada.ca/en/immigration-refugees-citizenship/services/application/application-forms-guides/guide-5482-instruction-fill-financial-evaluation-form-1283.html

NB: If you did not sponsor your EX husband OR were not sponsored by him, you don't need to worry; but like you, he will always be responsible for your parents since he co-signed for their PR.

Maybe just me, but I am having difficulty with the question.

I believe you are talking about a sponsorship/PR application. When all is put together, you submit. What "submission deadlines" are there? Nonetheless, I can see some difficulty with providing a police clearance certificate from the country of imprisonment and in answering questions about any criminal history.

Is the imprisonment pending bail, pending trial, or consequent upon conviction? If the latter, convicted of what offence? And for how long? Being in the greybar hotel is not exactly in harmony with having a PR application outstanding. Or conducive to submitting a PR application.
Everything was initially submitted in 2020, then were asked for additional documents in the beginning of 2022. Just recently the applicant was accused of theft and is being sentenced until March of 2023. After the sentencing we received notice to redo the police check and submit a video recording with a deadline for January 2023.

You don't get sentenced for being accused of theft. You get sentenced after a conviction of theft.

Although no income requirement you do still have to prove that you can support your family in Canada without government support so you do have to show a certain level of income, savings, etc. Sponsoring parent will only be for 20 years or 10 years in Quebec.

Unfortunately you and your ex are responsible for your parents for 20 years or 10 years in Quebec. You can’t cancel this. You need to count your parents in your family size. Yes you need to include your spouse’s child in the sponsorship if 22 or under and listed as a family member if 22 or older. You can list the child as non-accompanying.

You need to speak to your criminal lawyer and an immigration lawyer about whether these charges makes your spouse ineligible for sponsorship at the moment. What was he charged with and how long is the sentence? Is your lawyer aware that your spouse is applying for PR as well?

I don’t know the exact charges.

We have a consultant helping with our application and he is aware of the situation but he doesn’t think anything can be done. I am under the impression that he thinks staying quiet and missing the request deadlines is the way to go.

What I know is a tourist had accused the hotel staff of stealing from them. And all the employees working during their stay have been imprisoned as nothing was recovered by the tourist. I know they will not be released until March 2023. It’s been difficult to get any more information.

Where would one even find a lawyer for these situations?

It's generally a really bad idea to miss IRCC deadlines. Get rid of the consultant and hire a lawyer. You need an immigration lawyer. This forum is paid for by an immigration lawyer and you can try getting a consult from them. Click on the "cohen immigration law" at the top of the page. I don't have any experience with this firm personally. Other may have a recommendation for you.

Can my spouse apply for TRV, then shortly after that apply for outland sponsorship, and if the visitor visa is approved he comes to Canada and apply for OWP?
Does this option make sense?

If she can get a TRV she should fly to Canada then file an inland sponsorship. She can apply for an OWP.

Outland does not have any work visa options

Did you send the receipt showing that you've paid the RPRF?
You should send it back with an explanation letter.
I called IRCC in September and the agent told me that they have received RPRF Receipt and I am in que for COPR, I have showed a lot of patience but its january now like what is taking this long :(
