Hey everyone, so I'm a PR living in Canada with a family. 2 out of my 3 kids, and my wife are all PRs since 2020. We moved here this year, and between 2020 and 2022 lived in Singapore where our 3rd child was born. We got him a TRV and arrived in Canada. I then applied for PR on humanitarian ground using my personal account on this website: https://prson-srpel.apps.cic.gc.ca/, My third son is now only 1.5 years old.

My application got returned soon after saying that "We have reason to believe that a third party was involved in the completion, signing and
submission of your permanent resident application through the portal." It is obviously true since my son is an infant. I simply resubmitted the application again without knowing what else to do – because according to the same letter, an immigration representative (which is me, his father in this case?) cannot: "open a portal account on your behalf, electronically sign the application for you, sign into the portal using your username and password".

Could you advise what else I should do besides just wait?

Why did you apply for your son's PR under H&C? That's very unusual. Normally you would simply apply for PR through Family Sponsorship and not under H&C.

I was able to speak with an agent yesterday and it's still same situation: ELIGIBILITY : PASSED, SECURITY: PASSED, MEDICALS: PASSED, INFORMATION SHARING: COMPLETE, CRIMINALITY: IN PROGRESS. There is no information on my file when the Criminality check started according to what the agent told me.

Keyshia, what Country Police Criminal Certificate did you submit to IRCC ? It might be the reason for the delay.

I’ve been here for the pass 13 year so I don’t need police certificate from back home

This was recommended by my immigration consultant friend in Canada. He said I can't do family sponsorship when my son is in Canada physically – some of his applications were rejected and he had to reapply on H&C.

This is 100% wrong and makes zero sense. Your friend doesn't know what he's doing and clearly doesn't understand basic Canadian immigration rules and processes. Don't listen to anything else he says. He should not be working as an immigration consultant if this is the kind of advice he is providing. Honestly, this is just so so so wrong.

You absolutely can do Family Sponsorship with your son physically in Canada (as long as at least one of the parents is living in Canada when the application is submitted and continues living in Canada while the application is processed). This is the RIGHT way to sponsor your son. Withdraw the H&C application asap. This is the wrong program. There are no barriers to you sponsoring your son and the H&C application will take much much longer than a regular Family Sponsorship application. Submit a new application under regular Family Sponsorship. There are tons of people in the Family Sponsorship section of the forum that are sponsording dependent children right now (just like your situation) with the child in Canada. Go to that section of the forum and look for threads on dependent child sponsorship.

I cannot believe you got such wrong and horrible advice. Your friend is an idiot who shouldn't be working in this field. If his applications are being rejected, they are being rejected for other reasons. Probably because he sucks as an immigration consultant.

EDIT: Here's one of the threads dealing with dependent child sponsorship in the Family Sponsorship section of the forum: https://www.canadavisa.com/canada-immigration-discussion-board/threads/dependent-child-sponsorship-2022.779244/page-3
