Hello Everybody,

a friend of mine is since 3 months in Canada with a PR. She got it because she married her boyfriend from Canada.

They never lived together before and it turned out now, that the relationship doesnt work at all.
They both want to finish the relationship.

The question is, what happens with the PR in case of a divorce?

Regards
Isa

Thanks for your reply.

What means CBS and MOC?

I'm not a lawyer, but i imagined it to be problematic, too. What you suppose would be the best to do?

They fought very hard to get together (almost 2 years) and they never expected, that when they finally are together, that they can't be together in every day life. It's not an easy situation for both of them.

Thanks!

Still the question for me is, what she should do?
Are there any preventive things she could do, to make sure, she doesn't get a problem with the CBSA?

In case the CBSA would report her, what would happen? She would lose the Visa right away or is there a hearing first?

As long as neither of them say anything to immigration, I think it is unlikely that they will examine their case again. She should go on with her life as a PR and get her citizenship when she can.

I have read about one case where a woman was stripped of her PR after trying to sponsor a spouse which they used as an opportunity to examine her first marriage, declared it a marriage of convenience and took her PR although she had at that point been a PR for some years.
