Hello LegalFalcon,

My cousin and his wife are applying through PNP-O, along with 3 dependant kids.

Now, they know they're supposed to submit the birth certificates for all 3 kids, but do they also need to submit their own birth certificates, i.e., my cousin and his wife??

On the CIC website, it only says dependant children, but they want to make absolutely sure.

Thanks.
For the EE, the birth certificates are not required for the application and spouse, only for dependent children. However, for the OINP the birth certificates of all applicants, i.e. the PA, spouse, and dependent children is required.

The security or the BGC of an application is unpredictable. It can take as little as 1 day to as much as 2 years or more. On average, it is a few weeks. It all depends on whether an application is under 'Security Screening or not.'
Thank you. IRCC mentioned to me that currently my criminality and security are in progress. Do you recommend I order the report from CSIS?

Thanks for the reply @legalfalcon,
Apologies but I have got some of my terminology incorrect.

thanks @ legalfalcon.
Apologies but need to confirm, should be step sister not half sister from original scenario

Relatives in Canada
If you want to claim points, you can, but your will need documentation. If you do not want to, it is not necessary.

You, or if it applies, your spouse or common-law partner, have a relative:

  • living in Canada
  • 18 years or older and
  • a Canadian citizen or permanent resident
This relative must be a:

  • parent
  • grandparent
  • child
  • grandchild
  • child of a parent (sibling - Can be half)
  • child of a grandparent (aunt or uncle)
  • grandchild of a parent (niece or nephew)

Express entry
Not claiming express entry points for step sister in this instance. is this ok? yes
It is not necessary to claim points.

eAPR

The family section question
1.Does xxxxxxx have a relative who is a citizen or permanent resident of Canada? (The relative must be 18 or older and living in Canada?
What would the answer be for a step sister you don't know and have never met?

The answer is no if you are not claiming points.

2.Please tell us about xxxxxxxxxxx immediate family members that have not been identified in the application?
The first drop down menu has options for step sister & step father. Would they need to be listed here?

If it specifically asks for step sister and step parents, then yes.

Thank you for your help

Hi legalfalcon,
Is there any legal way to get attention of officer on our file? Like few inland applicants took help from MPs to escalate dr cases. It's been more than five months since case analyst's reccomendation was made and file is still awaiting for an officer's review. I am not under ss as security has not been started yet... Total time since aor is reaching to 8 month now.would you reccomend here to consult a lawyer , who can write to cic to pay attention on our file... bcz contacting customer care, and raising cse result in getting standard replies
The MPs do not influence or expedite the case in any way. They can only ask for the states and IRCC is obligated to respond to them within 24 hours.

The only means you have is:

Raise CSE
Send emails to CPC-CTD-Ottawa@cic.gc.ca
and order GCMS notes. When notes are ordered, an officer has to review the file before releasing the notes.

Apart from this, you will have to wait it out.

Dear Legal Falcon,

Thank you for your invaluable support through my process. I am a PNP Applicant -April 20 AOR. They didn't touch my file for over 105 days. I ordered GCMS Notes from your website and received them about two weeks ago. They were dated 30th August. Until that time my Criminality and Medical was passed and my US Shared Security showed NRT. Agent Review stated *** POLICE CERTIFICATES R10 OK Criminality Decision Passed** in the Notes. My eligibility and Security and had not started.

I have ordered notes again on 16 September - will I be able to see what's going on in London Visa Office?

Yesterday I called CIC agent and she told me she can't see my file as it has been sent to London Visa Office on 14 September and I asked her if Eligibility had passed and she said 'no' it had not and she could not see anything and last update was the application had been sent to LVO on the 14th of September.

Does LVO usually do the eligibility or only of their is some issue it is sent to them? At present I am on NA2 stage since August 21st and not reached IP2 yet.

Is this a normal trend or should I be concerned? I am living in Kuwait and I know all Kuwait Applications go to London for processing.

When selecting the NOC, the applicant does not need to demonstrate that they meet the “employment requirements” listed in the NOC occupational description or the designation, rather the job duties.
Thank u sir, so even if my designation is of manager level if im able to match the job duties mentioned in NOC with that of my reference letter i can apply.
Thank u

Thanks @legalfalcon One more piece of information. I called up IRCC and the agent informed me that my application was approved on 28th Aug, and the renewed passport was added to application on 30th August (even though I sent it on 14th Aug). So that might be reason that expiry date of my visa is shown as Feb 2018 as it was approved before new passport information got updated. That lady said that she can't do much as an agent and suggested to write an email to CPC-Ottawa.
Good part is she said she does not see that my documents/visa has been printed yet. So there is chance that they might read the email and may rectify. She also said that if the visa is printed, nothing much can be done.

Do you think they will take the new passport into account, and use this information to update the visa expiry etc? I know, it might be speculation, just checking based on your experience so far.

Thanks!
If the email is read and an action taken, they will. No need to worry on that account.

Dear @legalfalcon My first ITA was received in June. I applied and our application was rejected as they wanted my PCC for Dubai and the US.
I received my second ITA on 6 September and have all required documents now.
Dubai does not issue PCC on a visit visa. My total stay in Dubai was 7 months - over a period of two years. I have an email from Dubai Police saying that they don't issue PCC on visit visas.
My total stay in the US was 95 days. I have submitted the form for FBI and have the receipt.
My question is now should I wait till the end of the application deadline i.e. 6 Dec and then submit my documents or should I go ahead and submit everything now? My PCC for other countries will expire if I wait till December - These are valid till 16 October.
Please advice.
You can submit your application and in the LoE explain the PCC for Dubai, and also indulge the proof of applying for the FBI PCC. However, it is the discretion of the officer to allocate your time for that or not. Ideally you should have all the documents submitted, especially if you have time. Only in cases where you cannot obtain a document, and the deadline is approaching that you should submit the application and seek extension for the PCCs.

Hello @legalfalcon
As per your recommendation, I ordered GCMS notes which says my Eligibility, Security and Criminality is not started yet. Also R10 says OK- Recommendation Pass.
The only thing concerning me is - there is a note created by Program Assistant: CASE PARKED DUE TO THE FOLLOWING MISSING DOCUMENTS: CLARIFICATION LETTER.
This note was created on the same date and time when they requested me my travel info IMM5562 as additional document (Aug 17,2017)

Is there anything i should do about it or is there anything to worry ? Also please advice if there is anything else i should be looking for in my GCMS NOTES.
Your help will be greatly appreciated.
Thank You
When were the notes generated. If you did submit the information, it takes a few weeks time for them to add it to the file. Just keep a track of your application and order another set in a 1-2 weeks to see if there has been progress.

Do you have any note for eligibility?

Hello LegalFalcon,
I received my PPR yesterday, my sincere thanks to all your guidance. Am currently residing in US and planning to mail the passports to Ottawa.
Me and my spouse hold Indian passports whereas my daughter holds US passport. Should I mail my child's original passport too or photocopy is sufficient ?

Thanks,
Sasi
Heartiest Congratulations!!

Your daughter is from a passport exempt country, so you do not need to send her passport. Just the photocopy.

Hello LegalFalcon,
Thank you for your help and tremendous support on this forum.

After reading your post, I had submitted a request for the status of my immigration screening to CSIS via Fax:

Assistant Director, Operations
Canadian Security Intelligence Service
P.O. Box 9732, Station T
Ottawa, ON
K1G 4G4
Fax: 613-369-2954

They mention a processing time of 8 weeks. I have not received any acknowledgement or confirmation that they received my request. I faxed it on Sept 8th.

Is it typical of CSIS to not send any acknowledgement of the request?
Do they just send the report in 8 weeks?

Appreciate your feedback in advance!
CSIS only corresponds with written letters. So you will get it in your mail at the address you gave.

Dear Legalfalcon,

Is there any problem if I take job reference letter from ex-colleague on one date and get it notarised on another date?
Not at all. However, if you are not getting a letter on the official letterhead, you will have to include additional documents such as your pay slips, IR returns, etc.
