She can only sponsor you if she has no spouse or common law partner, no other children who are already in Canada, her parents are deceased and she has no other family members in Canada (e.g. brother, sister, aunt, uncle).

Is she making at least $37,234 and has she filed her taxes and declared this income?

If so, she can sponsor you.

Really that's a great news... is it possible that my baby and husband can go with me? or shall I apply first?
All three of you would be included in the application. Your mother in law cannot sponsor you. She would sponsor her child (your husband) and then you and your baby would be included in the application as a dependent. Because you have a baby - the income requirement she needs to meet is higher - $43,301.

Even though they have different surname's? My mother in law is using her maiden name.thank you
It doesn't matter. The husband's birth certificate would list the mother's maiden name anyway.
