Hello everybody,

I´m a shareholder in a very young Alberta corporation with business address in Edmonton that is considering the possibility of hiring a handful of construction cost estimators and surveyors from abroad to work in Alberta. We have some questions and concerns with regard to this issue. I´m really hopeful the wonderful and knowledgeable participants in this super Forum will be so kind as to provide me with some much needed insight.

Question/concern number 1:

We are currently negotiating the purchase of a larger and far better established Ontario incorporated business that operates in the same line of business. If we go ahead with the deal (which seems likely) this may imply that the construction cost estimators from abroad (TFWs) may be required to take part in a long term initial training program with a duration of approximately 12-14 months.

Every month, for one or two weeks, they would be in Ontario taking part in this intensive training initiative with involves in-class and on-the-job training - Solinex would always be the employer and would always pay their salaries, whether in Alberta or Ontario. Of course, we would cover the travel and accommodation expenses and all costs with training as well.

Is there any problem with doing this?

Question/concern number 2:

We envision the construction cost estimators spending a good deal of time on the road talking and negotiating with suppliers and prospective clients. At times, in the line of duty, heavy, large-sized tools, machinery, equipment and building materials may need to be transported to the workplace, showroom or even a client´s address. They may, occasionally, be called upon to drive a vehicle which requires Alberta Class 3 Licence, when the cargo requires a truck of relatively large dimension, no other vehicle is available or there is simply no one on call to drive them to their destination.

We will encourage all workers, not just estimators, to obtain Class 3 Driving Licence and we will cover all costs incurred to obtain this title. This will help our business avoid the unpleasant situation of being unable to respond adequately to customer demand which could arise from not having anyone licensed to drive a 3 axle vehicle or needlessly having to hire a truck driver to chauffeur the cost estimator around.

Is there any problem with the construction cost estimators driving Class 3 road vehicles if they are doing so within the context of their job and, basically, with the sole purpose of getting from point A to point B?

Your best bet is to contact your local Service Canada TFWP office and pose these questions to them. Your scenario is not exactly typical and they would give your precise advice on how to proceed so that you avoid complications down the road.
