RCMP clearance - outland application,

Hello all,

My spouse and I are submitting an outland spoousal sponsorship application. We have had all the documents ready for a while now but sadly our application is not ready for submission (or so we're told) because the RCMP police check results are not back yet.

As it turned out, the digital/electronic fingerprinting didn't work well because supposedly "some people's fingerprints are not clear enough in a digital test" :( the person doing the fingerprinting suggested doing an ink-based test "to be safe". While his logic was valid and his advice was probably good, we didn't realize at the time that this would mean a difference between a few days and a few months of waiting to even submit the application!!

Now my question is this - as an "outland applicant" are we able to send the rest of our documents in (we have everything ready - proof of relationship, medicals, police clearance from all other countries lived in for 6 months+, etc. etc.) and then follow up with the RCMP clearance later?? maybe if we just indicated by way of a cover letter that we are still awaiting the results and will send them ASAP??

Any inputs/advice would be much appreciated :) thanks a lot in anticipation.....

Were you specifically asked to send an RCMP clearance? Police certificates are required for all countries with the exception of Canada. Unless you were specifically told by CIC to include an RCMP clearance - it's not required.

Thanks for the prompt response!! That is news to me!! We're actually going through a lawyer and this was based on their advice - to send an RCMP clearance together with the package??

I believe this is because both my spouse and I currently live in Canada and have lived here for a few years now?? We have chosen outland for faster processing times etc...

So now in our case, do we still not need the RCMP clearance??

You definitely don't need it.

Unfortunately your lawyer gave you bad/incorrect advice.

It doesn't matter how long the person being sponsored has been in Canada. No RCMP certificate is required. When we submitted my husband's application, he had been effecitvely "living" in Canada for three years. We included no RCMP certificate and none was requested.

You say you live in Canada but you are filing outland. Ok I am also new here but I believe you cant do that. Outland means that at least the Applicant live in other country than Canada.
better wait for some more experienced answers before you do anything!

No - it's fine.

You can be living in Canada and file an outland application. People living in Canada can chose either the inland or outland route.

I agree but what about interview and such if needed. Wont they have to go to the visa office assigned. Can you explain?

Yes - they would have to travel to the visa office assigned if an interview is called. However for many visa offices interview are rarely required (only if CIC suspects the relationship isn't genuine).
