Question about 1000 / 20000 FSW limits

Just wondering if anyone knows how they count the 1000 NOC category limit and 20000 total limit for FSW. If they receive an application, does that applicant have their place in the 1000 limit reserved whilst their application is being processed? Or do they only count fully release PR cards?

It would be fairly heart-breaking to spend 6 to 9 months getting through the entire process, being accepted at every stage, only to be rejected at the final hurdle because the 1000th applicant in your NOC category has already been approved!

It's still not clear, though OP6 says that they will accept 1000 per NOC based on the receipt of the application at the CIO. On a given day all applications will be considered when nearing the threshold. So CIO may actually accept 1000+20 applications if 1000 was not reached the day before.
Clarity is still required on what stage will the 1000 be counted at; receipt/completeness/+ eligibility.

Anybody know something on this??

I believe that CIO will reject applications when it exceed the 1000 cap in any noc or 20,000 total limit after completeness and eligibility check.

Hmm I think the logical way to do it would be to "reserve" an applicant's place in the 1000/20000 limit after initial checking at CIO, and then release that place if the applicant is rejected.

Otherwise an applicant can pass every stage including medicals, at great expense, only to be turned down at the final hurdle because 1000/20000 already reached.

Ah well, guess we'll find out in due course as soon as people start getting rejected due to 1000 limit being reached on their NOC.

Both the Ministerial Instruction of 26 June 10, and OP 6 mentions that "A maximum of 20 000 Federal Skilled Worker applications, without an offer of arranged employment, will be considered for processing each year".

There is no mention of approvals, and I would think that the use of "processing" means that the cap will be determined (at the latest) upon issue of AOR. Otherwise, as was pointed out, it would be certainly be unfair for those who are made to go through the whole course and then find that they are unsuccessful - and worse still not because they had submitted their application late but because their VO takes a longer time to process the case. Just my thoughts.

Chanced upon the Gazette notification that announced the change. It states "In calculating the caps, applications will be considered in order of the date they are received. Applications received on the same date will be considered for processing having regard to routine office procedures".

So this means the Cap will be counted on receipt of apps. That's bad news, becoz for rejected applications the slot will be lost for the year. CIO may then actually end up with less then 1000 apps./NOC for processing.
So if somebody sends an incomplete app. his app. will be counted initially, but rejected later. However that slot will expire & no further app. will replace the open slot.
