Need Advice - Citizen Parent Applying for Child

Hi all, Below is my question. I appreciate any help/advice. Also, if anyone could give me a number of attorney who gives free phone consultation.

A canadian citizen who has become since 1997 has a 12 year old child who was born outside of Canada. The father (citizen) has not been back to Canada since 2002. I want to know what the procedure/requirements is to get the child’s certificate of citizenship. Beside the financial support part, does he need to show an intention that he would reside in Canada? Does the child need to be in Canada for some period of time to get her certificate of citizenship?

Side note: The father married his second wife (the child’s mother) while he was legally married to his first wife.

If your child was born outside Canada after February 14, 1977, and you were a Canadian citizen when the child was born, your child is automatically a Canadian citizen.

On April 17, 2009, the law changed to end the need to retain citizenship except those who turned 28 before the new law came into effect.

So, basically, your child is a Canadian citizen and you can apply for their proof of citizenship (citizenship certificate) any time, provided that -

1) his or her birth certificate issued at the country of birth states you as the father,

or

2) you applied for the child's Certificate of registration of birth abroad (RBA). - which I assume you didn't......

Your marital status before, during and after your child's birth does not matter. It only matters were you or not a Canadian citizen at the time of the child's birth.

3. If you (i.e. your child) were born outside Canada to a Canadian parent on or after January 1, 1947, then send the following supporting documents:

- A birth certificate which lists your parents (issued by responsible government authorities in the country where you were born) (i.e. your child's birth certificate should state you as the father)

- Proof that one or both of your natural parents were Canadian citizens when you were born (i.e. your citizenship certificate dated 1997)

- Two (2) pieces of personal identification, such as a driver's licence and a health insurance card, one of which must have your photo on it (passport and any other ID except the birth certificate).

- Other documents, such as a marriage certificate/divorce certificate and/or a legal name change certificate (if applicable)
