LMIA for unionized Roles - existing employee if a Foreign National

I have a foreign national on an IEC work permit who is currently working in a temporary role that is unionized. Her work permit will be expiring soon, and with no CEC draws likely for the next 6 months, we are looking at the option of an LMIA. Does any one know what the advertising requirements are for ESDC for unionized jobs that are only being posted internally, where the foreign national is on an IEC work permit?

There are no special rules for unionized staff. The same LMIA advertising rules apply which require external advertisement.

What country is this person from and how old are they? There may be other options.

Thanks for the feedback. This person is from New Zealand and she is 25. She's in a Temporary Full Time role as a Radiation Therapist NOC 3215. We cannot offer her a permanent role as permaennt roles go to those with more senioriry first, so she needs to build up her seniority before she'll be competitive. Problem is her IEC work permit is expiring in June 2022. the BC PNP isn't an option either as her role isn't permanent (checked with BC PNP already and they said no).

Ah - that's a shame. She's from a country that only allows one participation in the IEC program.

There's no getting around the LMIA advertising requirements. You need to meet them to get the approval.

Sorry, don't know what to suggest. I guess she has to hope the reports we are hearing are wrong and there is a CEC draw sooner (and she has enough points to be selected).

IMO that is a real stretch but I guess you can try.
