If my husband doesn't get approval as a sponsor in spouse's sponsorship because of lack of Option C (proof of income for sponsor) what would be the next step for me as an applicant?

There're some doubts. I think because of Option C that shows income for last year (he has sent explanation why he cannot provide it - because he didn't earn enough money) and modest ceremony of marriage (no parents, only witnesses) there's a big chance not to get 1st stage approval.

Maybe somebody have similar experience?!

There is no income requirement for spouse sponsorship. They want to see the sponsor's Option C to make sure that he did not receive any social assistance (welfare) from the government.

Plenty of people have provided explanation letters as to why they could not provide an Option C. We almost had to. If you are worried, see if you can contact Revenue Canada and ask them to mail your husband a letter stating why they cannot provide an Option C Printout, or that one is not available. I know someone did this in the past. Then wait to see if CIC contacts you about it. If they do, mail them that letter. Explain it to them again.

What you could do, as the person wishing to immigrate, is support and encourage your husband to overcome any reason why he was ineligible as sponsor so that the two of you can try again.

While there are no income requirements for Sponsorship (if thereare no children), you should provide an Option C regardless of income-level. Just include a letter explaining that while you did not make a lot, you have a new job or anything that might be relevant. You can file your taxes now for the previous year and get an Option C within a few weeks.

Guys, forget about Option C. Imagine Immigration Office says "you husband couldn't be your sponsor" may I still continue my process of PR receiving?

I answered that. If your husband is not eligible to sponsor you will need to wait until he is eligible if you are pursuing family class.

Why is he not eligible?

Why is he not eligible?
He has lost a lot of money and can show Option C only for 2008 or 2009. So I think that in spite he provided last Option C and explanation letter Immigration Office may say - he couldn't be your sponsor.

You've managed to confuse me, asking for respondents to forget option C and now stating that is what you deem to be the reason for refusal.

Well, you can wait until he can sponsor you (another tax year?) or find another category to apply within, which is tricky. There is no point to pursuing this application in the Family class though since he can't sponsor you.

He should still have an option C regardless if he's lost a lot of money or not. As long as he doesn't owe the goverment and has files taxes then there shouldn't be any problems.

If your husband is refused as your sponsor, your PR application is thrown out and you will be unable to become a PR unless you apply through a different route, like FSW or PNP.

If your only way of becoming a PR of Canada is through the family sponsorship and your husband is deemed ineligible to sponsor you, then you cannot get your PR.
