Greetings,

I applied for PR Card renewal back in October 2013. I didn't receive any communication from the CIC until I checked my status in May 7, 2014 to find out that my application has been transferred to the local office (Hamilton).

I would like to enquire about the following please:

1- What does it mean when a file is transferred to a local office
2- What period or timeline I am looking at in terms of waiting periods
3- I have an expired PR card now (August 2013 it expired), so do I still have an option to use the land borders for crossings (Buffalo), I have a US visa on my non exempt country passport
4- I am thinking of withdrawing the application as I have errors in the entries dates in my file and want to avoid escalating the situation. Can I still apply for a withdrawal to the local office or is it too late for that now?
5- If I am to cross the land borders, after withdrawals, will I need to demonstrate any ties to Canada ( I live here anyway, daughter in school and private car , etc)
6- If I am unable to withdraw, will my file be flagged at the land borders so I won't be able to re-enter Canada smoothly? I haven't travelled for 1.5 yrs now and need to do summer travels this year for my sister's wedding back home.

I truly appreciate your input and as soon as possible

On the date that you submitted your PR card renewal application, did you meet the Residency Obligations, and could you prove it?

Thanks for your response,

I didn't keep track of my stays in Canada but I am sure I have misinterpreted my dates at the time although they cover two years. I didn't do the counting myself but through an immigration specialist who sadly made things more complicated for me and rest assured that I meet the RO

1. This typically means CIC is looking into your application more closely because there are concerns about the information you have provided / concerns you have not met the residency obligation.
2. It varies. I don't think anyone here can give you a fixed timeline. I believe we've seen some people wait for over a year (at the extreme end of things).
3. You can use a land border as long as you don't travel using a commercial vehicle.

Many thanks for your input,

I am seriously considering withdrawing the application as if I have found misleading dates compared to the CBSA report , so they would too.

In doing so, will I be able to ask for a withdrawal even if the file is now at the local office and not at CIC head quarters?

1. You can ask for a withdrawal - refer to the procedure on this forum where many other applicants who 'suddenly remember' date issues have gone this route.

2. CIC will pursue any criminal related investigation including court proceedings for misrepresentation. Recent case law on citizenship fraud shows (actually confirms) that CIC and the courts no longer buy the 'it was my consultant' angle - you are responsible for all declarations. If found to have misrepresented you will be deemed inadmissible and issued a removal order. By the way most 'consultants' drop their 'client' when the legal smelly stuff hits the rotating air mover as it seems to have here.

3. Why could you not be honest and avoid all this? 730 days is a 40% residence requirement - as a certain Mr. Eastwood said "do you feel lucky"?

4. Not to add that actions such as this affect all other applicants by subjecting applicants to RQs (CIC being more effective would help) and such - messing with the RO eh!

If I wait to hear back from the local office and if I receive a letter asking to confirm the dates, do I have the option to explain the misinterpretation of dates?

During my five years, I have one year which I was unable to travel due to being stuck in another country for personal reasons including abuse and travel ban over my Canadian daughter at the time imposed by my ex, I never used that ofcourse in my file as I was advised not to.

So you claimed to be in Canada while you were not actually in Canada for a full year? Yeah, I think your 'advisor' should be fired immediately and you might want to withdraw that application as fast as you can type a letter and put a stamp on it.

Good luck, because it sounds like you might need it here.
