How comes its a permanent residence??

Hi all,

A permanent residence means that you permanently can live in the country, and you should be entitled to even live outside the country without loosing your permanent residency. But I can't understand the fact that in Canada they give us permanent residence but you may loose it if you lived outside Canada for certain duration. In UK, if you got the indefinite leave you can leave the country and go anywhere any time for any duration and come back when you like! Could you please readers clarify for me?

Because that is the way the Canadian Immigration Act was written.

In UK it is totally different because of the imperial heritage dealing with colonies. You can read more about it in Wikipedia.
In case of Canada solution is very simple:
live with that permanent residence permit in Canada for three years and get Canadian citizenship.
Now, you can live anywhere you want outside Canada and as long as you want and you will never loose Canadian citizenship.
That is the difference between permanent residence permit and Canadian citizenship.

Yeah. three years out of four years and you are good to go to apply for citizenship. Once you have it you are free bird. 8)

none, if the person is accompanying their Canadian citizen spouse.

its almost the same in UK u have to live 5 cosecutive years to get indefinite leave to remain

Sonea, yes that's right but once you got the indefinite leave to remain you can leave the uk with any obligations to return to it and you'll not lose you residency. It's a big difference.

Actually, that's not correct.

You can lose ILR (Indefinite Leave to Remain) status if you spend more than two years outside of the UK.

You need to become a UK citizen in order to be able to leave the UK with no obligation to return and without losing residency.

The UK ILR is actually extremely similar to Canadian PR. One could argue that Canadian PR is more generous because you can technically be outside of Canada for up to three years (vs. UK 2 years) without losing status.

If you have indefinite leave to remain (ILR) in the UK, you will be considered to be settled here provided that you have not been away for two years or more since you received ILR.
