Help - Apply for CEC with T4A - Great Thanks

Dear all,

I graduated from a Canadian University, Currently working with TD insurance as an insurance advisor.

I have commission employment contract with the company. It is a full-time permanent position, but 100% commission based.

The company issues T4A for this position at year end, instead of T4.

Will I be eligible to apply for CEC immigration with my case?

If T4A would cause problem, What can I do to increase my chance?

It should be OK. Please read the instruction & supporting document in the application T4/T4A is good enough.

Thank you,Tanoshi. Many people give negative result since T4A table would push me into the self-employment category, which was excluded from CEC.

As long as you have reference letter from employer and your job character (Commission based) there should be okie then

This comment has been helpful as i am in the same situation. I am a financial or insurance agent with sunlife. The noc code is 6231 and its commission based.

I was also advised by an immigration officer that i couldnot apply for cec because its considered as a self employment. However, i can only work/ sell sun life financial products and can easily get a letter from the company.

My question is where did u find that a t4A is good as well?

I just checked and t4a is not on the document checklist. It's only the t4.

Well, I am pretty much sure you`re not eligible with T4A cause you`re considered to be self-employed. You need to be a regular employee in order to qualify.

T4As are issued for non-wage income. This is usually for self-employed contractors, but for other things as well (e.g. student stipends - and some who have successfully applied as Research Assistants had T4As).

Whether or not you are eligible completely depends on whether the company considers you an employee. You say it's 100% commission-based (which is why your income is reported on a T4A), but do you receive any benefits? Health insurance, paid vacation, etc? Bonuses? Does your employer deduct taxes etc?

If your employer agrees that you have an employer-employee relationship, you have standard employee benefits, etc., then you should be eligible. If the company considers you to be an independent contractor, then you're self-employed and not eligible.

I am paid commission but my employer deducts taxes, group benefits from my pay. They also pay me bonus based on my performance.
I'm responsible for my cpp contributions. Does this make a difference now?

I think the key point is whether your "employer" is willing to put into writing that you are an employee...

Looking up info on career sales agents for Sun Life, the website indicates that "advisors" are in partnership with Sun Life (as opposed to employees) "A chance to be your own boss and build a business?" That is a self-employed agent, and not eligible.

I think TD has a different business model, a Sales & Service Rep looks like an employee of TD.

BOTTOM LINE - you have to ask your employer - no point in fooling yourself, you'll ultimately be disappointed.

I think it depends on the Employer. Reference Letter will be important in this case. The point is who give you T4A? and which information indicated in the form and other factors...
T4A is also for Base-Commission salary, too not only non-wage income....

Have you submitted your application or received any feedback yet?

I'm receiving both T4 and T4A, however, my salary was totally indicated on T4A slips.

Does this really matter?? T4/T4A??
