Getting Child benefits - Spouse Tax returns

I had applied for child benefits since am more than 18 months staying in Canada. My spouse currently stay with me as Visitor. When I applied for child benefits, I claimed myself as Primary responsible and upbringing up childs.

I got response letter from Canada Revenue Agency asking to file tax returns for my Spouse. If i want to file tax returns, She should need SIN # to get income tax returns.

How can i get SIN # with visitor record for my Spouse???? PLEASE ADVISE. THANKS IN ADVANCE!

You cannot get a SIN for a visitor.

You will need to submit your spouse's tax returns from your home country. Your spouse must have filed taxes somewhere, right?

Please see the below URL It says individual who apply for SIN should have one of the following documents that includes VISITOR RECORD... My spouse has VISITOR RECORD

Temporary residents must provide an original of one of the following:

  • Work permit issued by Immigration, Refugees and Citizenship Canada (IRCC).
  • Study permit issued by IRCC, indicating that you are authorized to work in Canada:
    • a study permit that indicates the permit holder “may accept employment” or “may work” in Canada; or
    • a study permit and a “confirmation to work off campus” letter issued by IRCC prior to February 11, 2015.
If neither of these requirements is met, you must contact IRCC to verify if you are eligible to apply for an amended study permit.
  • Visitor record issued by IRCC, indicating you are authorized to work in Canada.
  • Diplomatic identity card and a work authorization issued by Global Affairs Canada.

Only if that visitor record indicates that you are authorized to work in Canada. Does your spouse's visitor record indicate that she is authorized to work in Canada?

Nope, It doesn't indicate she can work. This is what I received mail from Canada Revenue Agency see below:-

"Our records indicates that your spouse did not file an income tax return for the year 2017 and 2018.In order to receive , your spouse must file income tax return.

You can get blank copies of income tax returns for the current years and previous year by calling 1-800-959-8281 or by visiting our webite at www.cra.gc.ca."'

If i want to file tax returns for my spouse in canada, She should need SIN # , please advise how can she file tax returns for the year 2017-2018.

Your spouse cannot file a tax return as a visitor who isn't authorized to work.
