Hi all,

my husband came to canada as full time student in August 2010. we got our PR in september 2013. and we travelled for one month outside the country after we got our PR ? when are we eligible to apply for citizenship ?? will the new rule come into place

thank you for all your advices

While as of now the new rule is not implemented and pre-PR time does count for half a day you need to reside 2 full years after getting your PR card, so if you became a PR and got your Landing done on say Sep 1 2013 you would be eligible Sept 1 2015, but again please use the calculator which will clearly state of you qualify or not.

It is likely the new rules will come into effect around June/July 2015, in which case time spent in Canada will no longer be eligible to count towards residency.
In any case, your husband will need to wait until September 2015 to see

1. whether the new rules have come into force
2. use the online CIC calculator to check whether he is eligible for applying to become a citizen

Lakky the new rules are not in effect yet please follow the residence calculator instructions enter the day you came to Canada, Day you became PR and enter today's date for the last one to see if you are eligible or not, the calculator will say when you will be eligible.

yes Sameera i did and it says 28th of September 2015 will be the eligibility. And iam checking with physical presence what would be the eligibility. As before we got our PR we went for about 2 and a half months outside canada for vacation ...

shouldnt have gone :(

While it is not absolutely certain that the revised section 5(1) of the Citizenship Act will be in force before September 2015, the odds are very high (more in the range of almost certain is my bet) it will be no later than September 1, 2015. Given the absolute minimum requirement of two years after becoming a Permanent Resident, even with no travel abroad before or after becoming a PR, there was virtually no chance of meeting the current residency requirement in time to apply anyway.

You are among many thousands (tens of thousands more likely) of other PRs similarly affected, on the cut off side the change in law.

That would happen no matter what the date was.
