To the best of my knowledge the legislation allowing them to do this has not yet been passed, but IMO it is a formality only.

Unfortunately what you said is true.. Legislations are mostly just formalities. Basically they are proposed to be passed regretfully.

Any protestation against the Canadian legislation may have the good result. Our protestation would tell them how much we people are affected with their decision.

Dear Applicant,

Thank you for writing about your concerns with regards to the government’s recent plan to eliminate the Federal Skilled Worker Program backlog.

The announcement of 30 March 2012 of the government’s intention to close the files, return the application forms and refund the application fees of some 280,000 applicants who applied under ‘dated’ eligibility criteria before 27 February 2008 is unfair and arbitrary. With talk of creating a ‘nimble and responsive’ immigration system and responding to the ‘needs of the economy,’ the Government of Canada is trying to paper over the fact that it is creating an ad-hoc skimming process for skilled workers under new criteria at the expense of those who applied years before under a good faith belief that their claims would be taken seriously. The government seems willing to wreak havoc with families who have invested time and energy in conceiving a future in Canada and whose claims should take precedence. Policymaking of this kind ought to be designed to apply to present and future problems, not retroactively to the decisions of applicants who were responding to policies in effect at the time of their application. This is a completely wrongheaded approach and does not reflect the kind of Canada I want to promote on the world stage.

As a member of parliament, I am committed to holding the government to account for its actions and ensuring that our immigration system is fair, sustainable and committed to long-term success, not short-term changes subject to the whims of ‘rapidly changing market needs.’ I have taken your concerns into consideration and hope to pursue this matter further.

I wanted to bring your attention to a news release from Minister Kenney's office yesterday:

It basically suggests that the new guidelines for FSW applicants about to be released would have a new point system, with emphasis on younger applicants, with high education credentials, and very high reading and writing skills in English. They must also be in NOCs that are in great demand, meaning they can get a job immediately...

Here is my concern, the news release states:

"change would allow new regulations, once approved, to apply retrospectively to people who have already submitted an application. "

This would mean that the new point system and its requirements would apply to all those who have submitted applications in previous years as well, in effect thousands of applications will be denied because they would not qualify. Only the few, with the above mentioned qualifications, will get through.

Nope....well that won't happen you are just interpreting it wrong.. It does not mean at all the applications after 2008 will be effected.it just meant that new ministerial instructions4 would follow that rule..

I would suggest you to read everything carefully before getting panicked...

They'll start the process of cancelling and refunding, IMO, as soon as the legislation is passed, which I expect will be by July 2012.

However, in order to ease the refunds they are having to give, I think they will ease the cancellations over a period of time.

Recently, you wrote to me with respect to the Conservative government's announcement that Citizenship and Immigration Canada would close the files of Foreign Skilled Worker applicants who had applied before February 27, 2008 and for whom an immigration officer has not made a decision by March 29, 2012. This decision was made so that the longstanding backlog could be eliminated.
You noted that this decision dashed the hopes and dreams of 300,000 applicants and their families.
Many of you had applied to immigrate to Canada, followed all the proper steps and waited your turn. Now you are being told that officials are refusing to even look at your application.
Now Stephen Harper and Jason Kenney are refusing to even look at your application. It is time to tell Jason Kenney and Stephen Harper that this decision is unfair.

Pl clarify about ECU. CIC is putting ECU as prefix on some files. what does this means? If cic is sending the file to ecu for obvious reasons but why to prefix file no with ecu? It can keep the file no as it is and send it to esu for processing.Your knowledgabe comments please.
