Hi Everybody

I have got PR visa back in 2011 enter Canada with my wife and a 2 year old child in May 2012 stayed for 17 days then went back to UK where my daughter born, we have decided to come back to Canada, myself returned in November 2014 and my family 2 children and wife came in Feb. 2015, we have third child born in April 2015 who is Canadian Citizen. Now planning to return back to UK in the end of June 2015 for good.

My questions are:

1. If we accompany a Canadian Citizen child outside Canada counts days toward our PR residency obligations?

2. I had online business in UK: if i open a Canadian company work for it and do online business from UK and pay tax every year in Canada does it help me to retain PR and this period count outside Canada.

If not can you suggest me the way i can retain my PR. your replies would be highly appreciated.

Thanks

1. No. This rule only applies if you are accompanying a Canadian citizen spouse abroad.
2. No - this won't meet the criteria since you're effectively looking for a loop hole (which CIC shut down years ago). You would have to be hired by an established Canadian company for a role in Canada and then later transferred to a role outside of Canada in order for the time to count towards retaining your PR status.

If you want to retain your PR status you'll have to meet the residency requirement by living in Canada for 2 out of every 5 rolling years.

For clarification: the credit is available to a child residing abroad with a Canadian citizen parent . . . a parent is not allowed a credit for time residing abroad with a Canadian citizen child.

You have been given good info. Living with a Canadian citizen child will not protect your PR. You have to either stay in Canada enough to meet the RO or you stay long enough to apply for citizenship, get it and then leave. Or if your spouse gets citizenship, your PR will be protected because you are staying with your spouse.
