I'm posting this on behalf of a co-worker/friend.
She is applying for the Young Professionals program but is having difficulty getting her employer (a university) to use the NOC code that CIC had suggested.
She is currently on a working holiday visa from Germany (expiring in March 2016). Her employer has already issued a contract renewal letter from March 2016 to March 2017.
The only NOC code that her employer is willing to use is 4012, while the ones that CIC suggested are 1254 or 4165.
The main duties of NOC 4012 match about 50% to what her work entails but she definitely doesn't meet the employment requirement (of being enrolled in a university program). The code seem to be reserved for people who are TA/RAs who are working as part of their stipend/funding.
NOC 1254 matches about 90% to what she does, but says "(except university)" so the employer(university) is reluctant to use 1254 and insists on 4012.
The unique situation with her job is that it paid through the university but the work is done at a research institution that is off-campus and based in a hospital.
It'd be basically a lie for her to use NOC 4012 and her application will most likely be denied.
So what should she do, if her employer isn't listening?
