My friend Heloise arrived in Canada from France on March 2013 with a Working Holiday Visa (part of the IEC: International Experience Canada Program) giving her an open work permit for a year.
She is now employed by a famous large company Nerd Corps as a Junior Compositor and then asked for the francophone work permit (or OB 429) which is a sponsored work permit requiring a skilled work O, A or B. She got the work permit without problem, classifying her under the NOC 5223: Graphic Art Technician, Skilled Work B. This work permit ends in April 4th. In the meantime, the OB 429 closed, removing all the possibilities of any extension (it was possible to extend this work permit up to 2 years previously).
She decided to apply for the Young Professional Visa (also part of the IEC) with the same position as Nerd Corps would like to extend her contract. But last Thursday, she got declined for the following reason: 'Your job offer doesn't match an eligible job for the Young Professional visa.'
Since she fills all the pay and working time pre-requisites, the only reason we could assume she got declined was that they thought her work wasn't a skilled work B. But it is! Not only Nerd Corps usually considers Compositors to follow the NOC 5241(Graphic Art Designer), but her current job offers is under the NOC 5223 which is a skilled work B as well!
We now think that the job description on her job offer wasn't explicit enough and doesn't look like a graphic artist.
we've decided to send a claim through the internal mailing system of the immigration website, explaining the situation and supported with a letter from Nerd Corps insisting on the qualifications of her current work. But we're still waiting for any reply from them... we're not even sure they're checking these kind of messages.
Heloise has finally be able to meet an immigration counselor today (Friday 20th) who went through all her application forms and papers, and she couldn't understand why she got declined, she thinks the same way than us, that the job description on the job offer wasn't good enough, and on the form asking for a work permit exempt of LMIA that the company sent, in the box for job description they said "see attachment", and they might have not liked this.
We think of trying to file a brand new application, but first, we can only participate 2 times at the EIC and we don't know if her declined application counts as one, and second we don't know if we should resign her current application before filing the new one. Heloise will ask her HR for a brand new job offer today with a job description that fits better with the NOC they're aiming for and we're thinking of sending all this by Tuesday.
Let us know if any of you had already experienced the same issue or if anyone here as a specific action to take to sort us out of this issue!
