dear friends

when i reach canada hopfully , I plan to let me wife stay 4 months each year so she and the kids wont break minimum time required to renew the pr card , for me i only can stay with her 2 months a year due to my work which i just began in the middle east ...

1-anyways is it possible to appeal on humanitarian grounds for me if my wife and kids maintain theire cards????is this usually sucessful or they are very sharp on this point??

the thing is i need atleast five years of independence practise as a specialist doctor to apply as a specialist in canada , and i just got my speciality and dont want to start all over again plus i already got a good job and need to make some money for the future

2 also if this fails then my wife have to sponsor me ? can she do it while living with me outside canada? and if she has to be incanada how long should she stay ? and is it true she need a job with high slaary in canada to sponsor me

i would really appreciate any suggestion i waited so long for canada and i dont want to lose it ???

It is possible that they will let you renew based on H&C grounds if your wife and children are living in Canada at the point of your PR expiry but I think it is unlikely that they will do it if none of you are really living in Canada and like you said, only the wife and children are spending 4 months a year to protect their PR's.

If your wife has to sponsor you for PR again, she needs to be living in Canada for the entire processing time. If they become aware that she is not in Canada, they can refuse the application.

1-does my wife needs to be workings or find a job in canada during the processing or its ok if she is not??

2- i already checked the website of cic and it stated the application take a 1 month processing inside of canada and 9 months at the damascus center ,is this for true ? does this means within 10 months i could come back and renew my pr or its the same story as the FSW processing which takes a couple of months at each step??

3 concerning her being there is this strict ? i mean if she come for a 1 months visit in the middle of the process would this be a deal breaker???or its flexible

i know i'm asking too many detailed questions but i guess this is my dieases i always wants to know exactly what is going to happen in the future and keep thinking on and on about it

i'm very thankful again for your help leon

She doesn't need to have a job or show income to sponsor you.

The likely processing time is probably 10 months.

Taking any kind of long vacation is risky because if they happen to check up on her and don't find her there, they may decide that she's not living in Canada and refuse. She should at least have somebody checking her mail and messages if she goes away for a month.

You would not be renewing your PR if she sponsored you, you would be getting a new PR so you would get the PR visa and have to land again.

so they simply cant refuse i get a new pr as long as my wife is still a pr holder and stays there to sponsor me ... well this is very good news because sending my wife 4 months a year wont be that hard plus i can already be with her 2 months there.

and maybe i wont let her sponsor me until i'm sure i will move 4 sure as i dont think i will have a 2nd chance to be sponsored if also i stayed outside of canada. i'm i right??

the thing is for us people in the middle east we have to always keep another door open , because even if you have a good job , life you dont know when you are going to lose it in one day due to a revolution ,war , sectarian violence ...ect

I don't think there is any limit to how many times your wife can sponsor you if you keep losing your PR but then again, if you are only going to visit and not live in Canada, you should be fine with a multiple entry visit visa until and if you want to move to Canada.

oh ! thats even better , you mean i could get a multiple visa entry easy if my wife just maintain 4 months per year??

for how many years do they usually give this visa for a person who have a spous maintaining the PR, i mean is it a 5 year multiple entry or 1 year or there is no rule usually

the whole picture is much clearer to me know , why dont you work as a lawyer advisor i know i would pay ;D

There is no guarantee ever to get a visit visa but if you have job obligations in your country and that is the reason why you lost your PR in the first place, they might see that you are not a risk to overstay. I think you can get multiple entry visas for up to 3 years. I am not sure. If you don't get it, then you still have the option of your wife sponsoring you.

I am not a lawyer and I only do this as a hobby. I don't think I would want to do it for a living.

Before they would issue a TRV to the OP, he would have to voluntarily relinquish his PR status at the overseas office.
