Can this student apply from within Canada for a NEW study permit. or will he be DEPORTED when he applies from Canada for being out of status?
does he have to go back to India to apply for a new study permit?

What's important is not the visa but study permit. If this "student" is staying in Canada after his study permit has expired without applying for a work permit then he is staying in the country illegally. I hope the "student" doesn't think that the CIC/IRCC will not know about his expired status.

If he has a valid study permit then he can extend the TRV after getting a new offer letter. If the "student" goes back to India then he cannot come back to Canada as the "student" will most definitely have his expired status on the record.
 
If the student really loved the woman he would go for spousal sponsorship. The fact that the student doesn't want to go for it means the relationship isn't really genuine.

He cannot apply for a new study permit while out of status in Canada. It's simply not possible. If it has been less than 90 days since his status expired, he can try restoring his status. If his status is successfully restored, then obtaining a new study permit without leaving Canada may be possible. If it has been more than 90 days since his status expired, restoration is not possible.

If restoration is not possible, he has to return to India and apply for a new study permit from there. Depending on why he fell out of status, how long he has been out of status in Canada, whether he worked while not in school, ties to his home country, etc. - it may be quite difficult to get a new study permit approved.
