Hello,

I got an offer from the Canadian company. The problem is that I am currently outside of Canada (in my home country), and I will not be back to Canada until March, 2021 due to family problems. When the potential employee heard that, they rescinded the offer, saying something about complications but they didn't clarify and all my attempts to understand the problem were useless. With that being said, they were very open to me working remotely for them (until they heard that I won't be back to Canada until March).

Can I work remotely for the Canadian employee from my home country? The Canadian company will be paying taxes in Canada (from my paycheck). I have a valid SIN, PGWP.

You can work remotely outside of Canada if your employer agrees. There is not rule that forces an employer to accept remote work outside of Canada. It's ultimately up to your employer if they are ok with this or not.

It is not about forcing an employer/employee to accept anything; it was more about the offer being rescinded so fast after 4 stages of the interview that I thought that there is something illegal.

Anyways; just a bad experience. Thank you.

In case this helps, the employer may have been concerned about some of the following:

You working in a different time zone and potential impacts to your effectiveness and availability.

Sometimes there are issues / concerns related to data and information privacy when someone is outside of the company's countries of operation.

They may have a company policy that limits how long someone can be outside of the country.

They may be concerned about what precedent this may set for other employees.

Many other reasons. Those are some possibilities.

Fair enough. We will never know.

As long as I don't break any Canadian rules that will make me ineligible to apply for PR, I will just take this experience as a good interview/technical interview practice.

Definitely not illegal. Some companies allow this. It's really about what their policies allow and accept. My recommendation to you going forward is to be very open about information like this early in the interview process. Don't wait until the end to surprise them with this information. I can absolutely see why this was a bad experience for you. From the employer's perspective it was also probably a bad experience since they thought they had their candidate and then found out late in the game that there was new information that made your hire impossible. Good luck and hope the next one works out.
