Worker wants to apply for permanent residence

Hi there,

I'm new with all those things so sorry if this question exist, I just couldn't find right answers.

I arrived in Canada three months ago, my company paid lawyer and he finished whole process for work permit so I came without problems. I got work permit for three years. Deal with layer was to he start permanent residence process when I enter to country, but we had some problems with him and he won't do that and my company won't take nothing further about that situation so I decided to take my own, since I have already passed English language test and I validated my degree diploma last year when I was here. I think I have everything I need to apply, but just not sure about all steps.

Do I need to follow those steps for Express Entry? I'm applying for Express Entry, right?

And also my wife came a month ago and she already applied for open work permit, we are waiting for results. Can she apply with me? I don't know which documents I need for her.

Can somebody help me please?

Have you read the three sticky posts on this forum? They have all the info you need to start with the Express Entry process.
 
This forum can be a great source of information, read the posts at the top of the forum.

The first thing you need to know is that express entry is a 2-stage application process.

First, you have to submit an "Expression of Interest" profile - at this stage, you need the Language Test scores and the Educational Credentials Assessment (ECA). You also need to identify your National Occupational Classification Code (NOC) - chosing the right NOC is CRITICAL to the success of your application.

You have to meet both EE criteria and the criteria of one of the 3 economic class programs. If you qualify, your profile goes into a pool of applicants. If your score is high enough (relative to other applications), you will get an Invitation to Apply to one of the 3 programs. Then you have to submit a complete application for you and your immediate family (spouse & children only).

If you intend to apply by yourself (most of us do), then you also need to become VERY familiar with the CIC/IRCC website.

Huh this sounds complicated.

I read some posts here, just for start wan't sure is Express Entry what I'm looking for.

Ok, I will check NOC, I read about pool of applicants, and ok, will follow steps you mentioned.

Just explain me more this first step.

I also check am I available to apply on CIC website, and got some code to use when I fill online application. You suggest online application or paper application to Alberta?

And also I'm confused about this express entry since everything I read is like I'm applying from outside Canada, not inside. Is there any difference if I apply inside or outside Canada?

There is no difference between applying for outside or inside. CIC will check which program you fits into (usually FSW or CEC). If you are eligible for both then it will consider you are CEC.

First step, calculate your points and let us know how much you get. If its less than 400, then you would have to improve it through IELTS or any other criteria.

Second step:

Confirm till which date your IELTS (Language Test) and WES Report (Education Verification) is valid (both yours and your wife's). Do you have LMIA or its inter company transfer?

Third Step: If your points are good (> 460), then apply for PCC from all the countries where you stayed for more than 6 months (total duration).

After these are done, you proceed with creating profile in CIC Portal and come back to us if you need any clarification.
 
It doesn't matter where you are applying from. Now to become a PR, you need to go through express entry.
Everything has to be done online now. No paper based application is accepted.
You have to submit online application after creating a profile on CIC site. You will be invited to apply for PR in the next draw if you have enough points.

I fill CRS tool form and got those results

Comprehensive Ranking System formula
Subtotal Core/Human capital + Spouse factors + Skill transferability = 316
Additional points = 600
Grand total = 916

Is this enough? Also my spouse didn't take any English language test and doesn't have ECA. According to this does that mean that she needs to take English language test and ECA before we apply?

Since you have LMIA, hence, your spouse may not need IELTS and ECA. With 915 points you will surely get ITA. Apply for PCC for you and your spouse. Also create your Express Entry profile. Refer to http://www.cic.gc.ca/english/immigrate/skilled/profile.asp

If you dont have 1 year of canadian exp, then you would be eligible for fsw (considering you have foreign experience). In that case, also check what are your eligibility points. It should be >= 67. Refer to http://www.cic.gc.ca/english/immigrate/skilled/apply-factors.asp for eligibility points.

I checked that, too. I have 82 points, so I should apply for federal skilled worker if I understand well?

You said that my wife may not need IELTS and ECA, how can I be sure that she doesn't need that? Is there any option to check? Or they will ask us for that when we start process if we need it? I read page on CIC when you need ECA and they said that only primary applicant need it, they don't say nothing about spouse. I suppose that she don't need, but just want to be sure.

I mentioned that she is in process for open work permit, we applied when she arrived in Canada, but processing time is 10 weeks so we will have response for about two months. Do we need to wait that response and then apply for EE or can apply now?

Are you sure you can claim 600 points for LMIA?

Is your job full-time permanent? You will need a full-time permanent job offer for LMIA to be qualified for 600 points.

Yes I have LMIA and full-time employment, contract for three years. My company applied for my LMIA, I got approve, have paper. Last year I was here for few months to work also I took English language test, also did ECA, everything is ready for permanent residence, just to figure out everything about my wife and to see all the steps, since lawyer should do whole process, but we had problems with him at the end and he won't finish process.

You have a contract for 3 years=> you do not have permanent job offer => you do not get 600 points.

You need to request them to offer you permanent, non-contract work

O my God! I'm totally confused right now. :o

This is what I have in my LMIA
"This LMIA is issued with reference to your stated commitment to:
Support both a work permit application and a permanent residence application (this means the employer will hire the foreign national as temporary foreign worker before or while the permanent residence application is being processed)"

And then in Annex A I have this
"Job offer has received a positive LMIA and may be valid to support an application to an economics immigration program subject to the Express Entry system."

In contract isn't defined that is for three years that's our deal and my work permit expire when my passport expire.

What does this mean then? What should I do?
