I've run across a situation in which a refugee claimant, who is on social assistance and has an open work permit, is inquiring whether her dependent 16 year-old daughter is also eligible to apply for a work permit. The daughter will be attending high school full-time, but wants to work part-time (weekends/after school). I have quoted from the link below, and it does seem to indicate that she is eligible based on being a family member. There is no mention of a minimum age or even attendance at school. Can someone please confirm if the daughter can work?

You may be eligible for an open work permit if you:
  • are a refugee, refugee claimant, protected person or their family member

Hard to know as an asylum claimant. Asylum claimants are only given work permits in hopes that they will stop claiming welfare. Since the child going to a part-time job will not result in the parents not receiving welfare they may get denied. If they are approved yes they have a good chance at receiving a work permit. Worth a try either way.

I have also come across a similar situation where a refugee claimant's daughter who is 16 years old received a work permit already. However, they do not need one for her since she is a minor and going to High School. Can anyone please advise whether the daughter would be able to continue her study as she just received an work permit? As far as I know that a person cannot study if s/he is on a work permit. Any suggestions would be highly appreciated.f Thanks!

She/he can send another request for study permit. I guess, someone ticketed work permit instead of SP
