Hello everyone
Friend of mine wants to withdraw his refugee claimant after waiting. For 3.5 years without hearing .. anyone know how he can get back his expired passport which is seized by the Cbsa ? How can he renew it before departure or the the Cbsa will send it to the consulate for renewing ? And if he don’t want to go back to his home country can he choose where he wants to departure ? Thanks

If his passport is expired he should be contacting his home country's embassy. He may be able to renew his passport or get a travel document if renewal is not possible.

his home country embassy said they will renew it but they need the expired passport and Cbsa will not give him the passport only in departure .

Your friend can withdraw the claim and take the Notice of Withdrawal to the CBSA and they will make the arrangements for departure. As to where the person goes, one must be lawfully admitted to another country in order to effect their departure from Canada, but it could be that the country of citizenship is the only one that may satisfy them.

Hi - It's difficult to predict as it can depend on where he's from, where in Canada they are, what connections a flight might require, blah-blitty-blah. "Removals" is a liquid process where countries can change what they'll do or won't do anytime.

You go into a sort of negotiation but they hold all of the cards. They just want a reasonable plan and the statistic, so be cooperative and pleasant so that they'll be professional and reasonable.

Essentially CBSA likes to hold the passport until you are on the plane leaving the country. They don’t like handing back a passport without knowing you are in your way out.

Find your local CBSA office, or the one that is closest to where you made your refugee claim. they will assist you in getting the documents needed and help you with flight details so that you can leave.

Remember. If you withdraw your refugee claim and leave, since it was already referred to the RPD, you can never make another claim in Canada again.

Do you have any idea if Cbsa will give him the passport to renew it before departure and when the passport will be giving to him before boarding the plane or to the flight crew?

More than likely you will not be given the passport to renew . Once the CBSA gives you the passport, the situation changes. And why is it important if you’ll be given the passport directly or via the flight crew? That’s irrelevant
And makes one think “ What is this person up too ?”

Quite possible CBSA will arrange for an emergency travel document from his home country for his travels. It’s highly unlikely CBSA will just hand over the passport because he asks.

He needs a valid passport or one time travel document. Would get in touch with his home country embassy in Canada to ask about getting a new passport or a one time travel document.

I recommend him getting a direct flight then he wont need a valid passport to enter his country of citizenship
