That, unfortunately, is not the point. You are doing, albeit for free, a job that a Canadian could do for money. This makes it "work". Not my rules... Just letting you know how IRCC views it.

Unfortunately she can't hire a nanny or caregiver coz of lack of finances. My parents are both old as well to come here and help
 
Agree that you need a lawyer. Although you are supporting your sister the family would have to pay for childcare if you weren't in Canada. That is why you could be considered to be working illegally. You are also caring for your sister which could be done in by a psw or nurse. It doesn’t matter don’t have the finances due to your immigration status.

Given that the father is still alive there is someone to care for the children if you left. There are many single parent family in Canada. It does seem like he is not the best father and husband but he may step up if you are not there. Are you able to survive financially if you can’t work for another year at the minimum? You can definitely try to apply for H&C unfortunately if you get denied you will struggle to visit Canada in the future.

Support coming from a relative is different from support who gets paid to do it. In terms cancer I think being around family is more important than anything that money can buy .

There may be compassion if you are in hospital with your sister but when you are not a PR or citizen your help it is not viewed as just a family helping out especially over such an extended period of time. This is something that may come up f you apply for H&C especially in regards to childcare.

I wouldn’t risk leaving. Your chances of being refused at the border is much higher than after submitting an extension online. A student permit will be extremely hard to get given that you have been visiting Canada for so late no. You must prove your home times and that you will return to your home country after your studies in order to be approved for a study permit. You’d also need to show that you have access. To at least 25 K.
 
What's the best option for me ? My sister also put me as a guardian and trustee for her life insurance just in case she past away. She did chemo but didn't work and now on palliative treatment. My tourist Visa will expire January 2020 . I appreciate it all the help from you guys
 
You and you4 brother-in-law really need to sit down and talk about the future and what will happen if you are not able to stay in Canada at some point. I assume your sister’s prognosis is not great although with immunotherapy you never know. Hopefully he will get more involved to support his children.

The thing is he is planning to leave again and wanting to accept a job driving across the country so he will away for couple of weeks or months . He just came back from a vacation few days ago. How can I talk to a self centered person who only thinks about his own happiness . I feel sorry for my nephew and my sister. He also barely support , my sister was lucky enough to get approved for critical insurance that's what we use ever since she got sick

Their father is their guardian since he is alive. You would need to go to court to get guardianship of the children and remove his guardianship. In terms of life insurance hopefully your sister has left you information about the policy and approximately how much can you expect to receive. Depending on her choice of burial options some of that money will likely have to go towards funeral and burial expenses. You don’t have any obvious options except to try to apply for H&C if you don’t qualify to immigrate using express entry. As I previously said you won’t be able to work or access medical care for 1+ years and H&C can take 2-3 years to finalize. Can you afford not to work until you get a decision about your H&C? The first step is to see if you have been awarded your previous extension and for how long. Best of luck.

My sister have half million insurance I believe. But we're not going to give up,she will get well.

A student visa is an expensive option. You will need to study full time to be approved and you will need to show a bank balance of at least $25,000 to cover your tuition and living expenses for the first year of studies. You can expect tuition fees to be $15,000+ per year. You will also have to plan to take a course in Canada that makes sense in light of your previous education and work experience. I personally don't think this option makes sense given your objectives for being in Canada.

Note that you are the one who will have to apply for the student visa - not your sister. Are you willing to attend school full time? You will need to be a full time student to get a visa approved.
