Will it count as common law if we live outside Canada?

My girlfriend H and C document got declined last month. It is almost impossible for her to come back as a visitor because she is from Vietnam ( it is very hard because she had an immigration paper in Canada in the past). I am thinking about moving to Vietnam to live with her for a year and sponsor her as my common law partner. I don't know if it is possible or we have to live in Canada for a year.
