Hello All;

I hope you are all well. I need help so I thought I would reach out here.

My son and I are Canadian Citizens (British Dual) My Wife is Filipino & British Citizen (Dual) We currently live in the Philippines but would like to move to Canada.

My son and I can just hop on a plane and arrive no issue, my wife would arrive on her British passport which gives her an automatic 6 months (MAX) visitor status. Before we moved to the Philippines with the wife, I invested into a house which my Mum, brother and I all own out right in Canada. So no need for mortgage or rent as we have a permanent residency there, my Canadian drivers license also has this address on it e.t.c

So my question is if all 3 of us arrive in Canada and she gets her visitor visa, can we apply while she is there for the 6 months for residency for herself, without her going back to her country? I am guessing that is what INLAND is? Also I invested my savings into this house we own here in the Philippines, so can my mother and / or brother be her sponsor since I do not meet the income bracket. Even though I own some of the home there e.t.c? In short she / us would not need assistance or any government aid AT ALL, So if my family sponsors her only showing that we own the house outright e.t.c should that be ok?

Sorry just a massive undertaking and I need some clear answers.

In short you can apply inland as you suggest.

If you read carefully, there's no formal income requirement or bracket. The only firm requirement is that you're not on social assistance. You won't need to fill out the financial evaluation form.

To the extent you do need to 'show' (note they don't say 'prove' here) you'll be able to support, savings, income from your property in PH if there will be any, and plans to work (both you and spouse) in future all taken into consideration. You can also note you will all live in the house you own as it seems that is the plan, i.e. lower need for income.

Note, I'm less familiar with inland, others can perhaps comment if there's anything more of note in terms of what you provide to show this or that might be relevant since you'll basically be arriving shortly before applying (and e.g. little/no Canadian income right away/little tax info).

Awesome thanks for the information, takes a fair bit of stress off my mind knowing this. We are planning on Renting out our house here in the Philippines, so that would be income from said rental, and yes we both plan on working there as well.

Also one other question does my wife need an outbound (round trip) ticket when entering Canada even though we are applying for residency inland? As I would rather use that money for the application fee.

I don't think these days a round-trip ticket matters (it might have when one-way tickets were more expensive or unavailable). Since a brit she could be planning to travel to UK later. And these days, who buys tickets well in advance when so many airlines cancelling flights?

The bigger question is how the CBSA officers treat so-called dual intent visits, where someone entering on a visitor's visa/visa waiver intends to stay and apply for PR. It's at the officer's discretion.

But overall they seem somewhat relaxed about visitor's from visa waiver countries. It's okay to say visiting for the term of the visa, or perhaps key phrase, will respect the terms of entry/depart when required. (Subseuqently okay to request visa extension). Don't lie if asked, obviously, but you don't need to bring up the issue.

With a child and all travelling together, perhaps more likely they will see as normal to accompany while arranging for school etc.

That said, frequently noted "don't show up with all worldly goods on a visitor's visa." I guess the implication is if the spouse enters with twenty pieces of luggage, they won't leave.

You can read here and check others' experiences, unfortunately there's no one answer that removes all uncertainty.
 
I should have added - right now the perhaps bigger issues are the covid restrictions; your wife will need to prove she's spouse of a Canadian citizen (eg marriage certificate plus photocopy of your passport), and quarantine plans.

Of course, who knows what will be in force two or six months down the road?

Thanks again for the information, it will not be happening this year anyway but early next, so maybe by then the entry restrictions will be a little lighter. The 3 of us visited 3 years ago and she has loads of clothing there (winter clothing) And all we live in here are shorts so really we would not bring much of anything apart from documents and a few changes of clothing as everything we need is already there.

Previous track record of visiting will likely help, should be okay. Always up to individual CBSA officer though.
