It was our intention to seek for marriage right after entering Canada back in 2014. However, due to lack of progress on the divorce i was seeking, we were delayed getting married. We have three children who are born in Chile, but father is Canadian and Indian Status. They came on visitors and then we applied for citizenship but has been delayed now 3 years, to what ends i am not sure. They keep wanting more information which we submitted birth certificates and identification. They actually got their status cards (first Nations) and have been in and out of the country by land to united states, since they can legally do so without any passport. They also get full medical coverage as well Health care card. They have canadian identification as well Status Cards. Now the wife passport and papers were stolen, we can get them replaced but now the story begins.

When i brought them in the country we were 100k a year job with the oil and gas recession i lost that and been on unemployment and living on my own. Now we want to get the wife established back in to the country without leaving and medical coverage, can i do that without leaving teh country we have established our selves within the catholic community and have now 3 more children born in canada, we have active socila and many of the support our children get are strictly as a results of status indian, full hearing aids, dental and eye, along with tutoring support etc. we need help to get my wife back into the proper process. any ideas.

You will need to sponsor your wife using the inland spousal sponsorship process.

Note that you cannot be on social assistance / welfare when you sponsor her. If you are on assistance, you will need to stop taking assistance when you apply to sponsor her and also remain off assistance while her application is processed.

The issue really is we need help from social assistance i lost my school funding and just started to go back to work, I havent been on it ever, each time we looked at it, twice they said they would have to notify immigration and that scared me off. I understand social assistance aspect, and was told very clearly best interest is to stay away. However that being said, if i was to get social assistance 1 time to get caught up , would that hurt our chances in the future lets say next month when i start the whole process for her

In my opinion, that would seriously impact your chances of a successful sponsorship, especially as your basic circumstances would remain unchanged. Get a job, any job, and establish a pattern of financial stability.

If you want to take social assistance once, you can certainly go ahead. However you'll want to be off social assistance for at least three months before submitting the PR application and show that you are working and able to support your family without relying on assistance.. You also need to stay off social assistance for the year (more or less) that it takes your wife's application to be processed.
