My work permit extension was denied but I applied for a visitor’s record within the restoration period. I am putting in a spousal sponsorship application soon. As I’m technically out of status, when can I apply for a SOWP if there is no response to my visitors record at the time of applying for spousal PR- At AIP stage or would I be able to apply as soon as I receive AOR?
 
You are submitting an Inland (SCPLC) sponsorship application, right? This is the application that waives the requirement for having legal status in Canada.
Since you did not apply for Restoration of Status when your WP extension was denied, you must [now] wait until you reach the AIP stage to then be eligible to apply for the OWP.

Your answer is a bit confused for who does not understand the process for family sponsorship. To be clear:

Applicants out of status can apply to become Permanent Resident in Canada under family sponsorship, but for OWP only after Approval in Principal (AIP).

Looked to me like the OP has more than a basic understanding, since they seemed to realize that without legal status, they likely had to wait for AIP.

But, thanks for `making it clear', even though you never mentioned that an Inland application is the only option for the OP; `family sponsorship' is somewhat vague as it could imply an Outland application (which many people submit whilst being/living in Canada) offers the same exemption. It does not.

I am submitting an inland spousal application and I did submit a restoration of status within 90 days of WP extension refusal. I’m asking at what point do I have to apply for SOWP given that my restoration is in progress and there has been no feedback yet from IRCC

Yes, I totally understand the process and agree that an inland application is the way to go. I’ve read on forums where out of stud spouses are able to apply for a SOWP after receipt of AOR due to their restoration being in progress. Was wondering if same would be applicable to me or if I need to wait further down the line until restoration is approved/AIP to apply for SOWP
